Jon Postel was the editor of the RFC, Request For Comments that academics shared back and forth between each other as the academics were building the "whatever" their employers had them assigned to work on.

The date of the schematic was 2 . 25 . 1982  over a decade before ICANN was created by President Bill Clinton as a private not-for-profit entity to take over the Internet from the military.

ICANN was a "friends with benefit" creation.

It is not about Obama. The game plan of telecommunications, the agenda, began back in 1858 with the ITU. The ITU in 2015 includes the Internet- data. The United Nations wants it.

Lest we forget, the United Nations is a business league that somehow the powers that be agreed to give tax free status. The United Nations went one further when the UN began giving out surrogate NGO status that countries assumed to be legitimate non-profits. Count them all. Count the tax dollars lost.

The One World government that HERE adresses is not farfetched. In the ICANN ball of wizadry, there is a 1net.org and in the UN ball of wizadry there is Agenda 21. I recommend reading both sites. Print what you read. As we are aware of the internet, what you see is not what you may get minutes later.

In 1998, President Bill Clinton authorized NewCo which was one of a handful of entities wanting oversight of the IANA function. Clinton also authorized TOR, the Onion Router. TOR? It is that masking tool, that anonymity tool that was military developed as was the IANA technology.

TOR is a smokescreen, a magic act, using complicated network of rabbit holes and tunnels to 'enter here' and 'exit there' unseen, sorta like a Facebook employee being the point person for the Arab spring or maybe even Bhengazi. One could sit at home and impact a world away without being there. TOR's team spoke at State a few years back, without conscience of their conscripting innocent person's identities to cause 'disruption.'

Yeah, 'disruption'. Now, isnt that a word we are all learning to fear.

Mrs Clinton in interview said the other day the technology used by her was set up with/by Bill's office. Yes.

And Vint Cerf said, Al Gore was put in to the Senate to get the internet moving forward. The agenda is always secret green, hidden money.

ICANN has exploded from a $70Million a year non profit to almost a 1/2 bill in a short few years to a predicted trillion plus. Tax payers seeded this venture Bill Clinton took private a short month after Google emerged. Google emerged from Stanford, a college lab, the US government was giving Tax payer funded tech to.... can we say google glass anyone? Or driverless cars? Or....

I have been writing about ICANN, IANA, TOR since stumbling upon them at a Judiciary hearing. I have been adressing how outside of America ICANN, IANA, TOR are worries. It seems no one is letting their cries be heard. They are upset. No. Dont assume your legislator grasps the end game that is getting worse... data... control of the internet. Tragically, too many legislators and staffers are ill informed. Lack of time. Lack of knowledge and friendly friendly lobbyists paid to schmooze, lunch and dine.

Take a moment. Go to the registry sites. Read the complaints pages on IP theft, TM violation, ID theft. Then head to the WIPO complaints. Yeah. Contrary to what legislators have been drinking the kool-aid of, you have to go to Switzerland when someone steals your name/brand, easier done these days with the thousands of TLDs, Top Level Domains, the endings on your domain name. Used to be just 5. Now? God help us all. We can be sitting here in the White House and thousands of impersonators can be around the world pretending to be us, and the Department of Commerce has allowed this to happen.

The elephant in the room question is, how has the Department of Commerce renewed the ICANN contract for 20 years without putting the contract out to competitive bid each year.

I would say believe Vint Cerf when he says IANA is going to the UN in 9/2016, after all, that is the month America got hit once before except this hit is just before the elections. Be worried... this ICANN thing is linked in to the global financial system. Now why isnt that a surprise to you....

      Vint Cerf  the “inventor” of the Internet announced that IANA is being taken from America September 2016. This is not a joke. One hopes it is not a prophecy, a 9/11 of the financial global internet kind. Vint Cerf also said that Vice President Al Gore was made Senator to make the Internet happen.

      Vint Cerf’s internet is out of control.

      Identities are masked on the “open” internet. Online crime is exploding. Wall Street flash crashes frequently. Terrorism, racism and theft look like they are happening from one person when they are instigated from elsewhere. The website people said was the South Carolina shooters appears to come from Russia. The fake Bloomberg.market website appears to come from Poland. The domain of a website showing a video of the burned alive Jordanian bomber burned alive surrounded by pornography appears like it belongs to the Toronto Yacht Club.

      ICANN’s CEO Fadi Chehade testified to Congress ICANN is successfully policing the Internet. ICANN, the Internet Corporation For Assigned Names and Numbers controls IANA, the Internet of Assigned Numbers Authority.

      ICANN, was ordered set up, 10/1998, as a non-profit by President Bill Clinton yet a lot of people are making money from domain names- the web hosts, the registries, the servers, the Internet groups. Vint Cerf predicts ICANN will be making trillions of dollars. ICANN IRS Form 990’s show a claimed revenue increase from $72,019,349 in 2012 to $236,182,149 in 2013. ICANN CEO Fadi Chedahe told ICANN volunteers at a the CSIS meeting in DC that he was setting up overseas banking in Hong Kong to overcome money difficulties.

      The Internet is a complicated yet profitable business to run. A lot of people are making a lot of money. The internet was developed by the American military Department of Defense for Advanced Research Projects Agency, ARPA. The Department of Commerce has been renewing ICANN’s contract to oversee IANA, since 1998.  Several companies had bid on the contract.

      The business structure of the Internet is complex. ICANN, with oversight of Domain Name System, DNS, tracks and regulates domain names and addresses. Domain names end in what is called a TLD, Top Level Domain. The TLD’s until a few years ago were .gov, .org, .net., .int, .mil, .com, .edu and .arpa. Jon Postel, the manager and developer of IANA, first addressed country TLDs, in 1994, two years after the United Nations Development Programme, UNDP, had controlled the country code TLD, .af, since 1992. .af is the country code for Afghanistan. A few years ago, ICANN began rolling out thousands of TLD’s. ICANN had oversight over the registries and the TLD and domain name marketers.   Domain name disputes are forced to be settled by arbitration as the people Hillaryclinton.com, donaldtrump.com, Georgesorosfundmanagement.com, Nichole Richie, Nicole Kidman learned.

      October 1998, ICANN President Clinton authorized ICANN into existence as a private non-profit, 6 years later. Clinton’s Oval Office aide Ira Maizinger still is involved with ICANN. Maizinger works at the Clinton Health Initiative.

               Clinton authorized developing the masking technology, TOR. The Onion Router, TOR, was used at the State Department under Hillary Clinton. TOR is used by groups wanting anonymity like Anonymous and Silk Road. TOR makes it look like one person is responsible for something that someone else did. That other person can be thousands of miles away. The ISP of the ‘inciter’ is taken for bad use without the person knowing. Postel knew IANA and its servers was insecure. Postel hacked 10 of the 12 servers in 1998. Postel was , unexpectedly, dead a few weeks later. The person who read “Postel’s’ testimony to Congress supporting ICANN emerging.

      ICANN wants control of to be taken from America to Geneva. ICANN will be put under United Nations oversight, along with the ITU, international telecommunications unit and WIPO, World Internet Property organization. The ITU is the world’s oldest union, formed in the 1800’s.

Custom TLD’s ending in words like .dog, .porn and .sucks can be strung together like beads .taylor.swift.sucks.dog.porn. Two letter TLDs like .ly, can be added to the e for example, “taylorswift.ly or .taylor.swift.ly.sucks.dog.porn. The government order Postel tried to block became law, about two weeks later.

ICANN was born from Newco. A closet industry was kept under the Department of Commerce. Few knew about it even to this day other than vested parties.

Rules IANA and ICANN were to follow were not. Trademarks and brands were stolen by “squatters” seeking to profit off of others investment of work. Website creators were led to believe they owned domain names. No. Rented not owned. TLDs like .org and.net were “rented” to people and entities that were not .org, organizations, or .net, networks, by people wanting to block others from feeding off their name searchability for “hits.”

Hover writes that buying someone else’s trademark is bad faith without adressing there may be complicitness is selling someone’s trademark, as starters.

ICANN broke rules of its contract. Now, ICANN is putting domain names on sale. .Co can be ‘bought’ at a discount, ½ price off.

ICANN is taking to charging tax on premium names too. Question is did Congress ever do diligence on the Department of Commerce issuing renewals to ICANN’s 20 year contract to assure that contract was put out to competitive bid. Did Congress ever do a forensic accounting of ICANN’s billables and financial statements. If not why not? Moreso, the profits ICANN is bringing in by the buckets, increasing from $70mil to 1/2Billion in a few years should go to the Veterans Affairs, and other beleaguered agencies, after all, taxpayers money paid for IANA and, for the record, Google, too.


Not even Taylor Swift has enough money in the world to protect her name. The Tech offensive starlet's team bought .sucks and .XXX and .porn to protect her brand. Look below, Taylor's team. Then Square that number to see the infinite combinations of those brand abuses. Nothing other to say than, "That sucks." It does.     IANA abuse bumped Twitter’s stock value up 7 percent from their closing price to $38.56, on rumor the Twitter was being bought out for 31 billion. It wasn’t the first time Twitter share values have been pumped. A website domain, Bloomberg .market, said Twitter received a takeover offer worth $31 billion.

    Law enforcement experts tell people follow the money. That wont be easy here. At least the starting point is closer to home.

    ICANN was enacted by President Clinton, who also authorized creation of TOR, the masking took used to disguise the identity of visitors and entrants to websites. Securities commissioners have been overwhelmed with the increase in online frauds. Trademark domains were not to be sold to non trademark owners. Somehow, ICANN, IANA and WIPO did not get that memo. The UN’s WIPO has been making big bucks fielding domain fraud complaints after the fact of the trademark abusive domains being sold.

    Owners of the harmed domain are forced to address this matter in Europe where WIPO, the domain DRS entity that Congress approved is set up.

    Despite knowing online fraud was trending up and higher, the SEC still decided to move forward on their permission for crowdfunding, largely an online community effort. The SEC is chasing the tail of a comet with these exploding crimes. A Bulgarian man pumped Avon and Rocky Mountain Chocolate Factory stock with false takeover claims. A fake statement of accounting problems dropped the share value of British security services company, G4S.

    Pumping and dumping stocks was a problem the SEC was struggling with managing even before this newest trend of Identity Theft.

    Legislators have not caught up with the crimes. Congress, despite struggling with containing the faster type of theft problems the internet bought with it, is actually considering releasing control of IANA to Europe where ICANN, the profitable non-profit plans to take the domain function, with little opportunity to contain IANA crimes that will occur when ICANN takes IANA to Luxembourg.

    Congress letting IANA go out of American control, keeping America out of this cash cow taxpayers paid for, is a bad idea getting worse.

            Mysterious moves are going on in the stock market. Some mysterious moves are reported on. The sexiest headlines ricochet around the world, like Madoff, the 2008 crash, and Wall Street and media termed “Flash Crashes”, noticed in 2009 and 2010, long before the NYSE halted July 2015 trading.

            No one talks about Markit, oddly, not the media nor Wall Street. Markit is one of those things an SEC employee said is illegal but hasn’t shut down. Markit is European technology that updates self trading investors on when to buy, when to sell, when to reduce, sort of like an online CNBC trading hour show. There is a difference.

            Markit tracks investors moves potentially influencing Wall Street and other market moves. Markit operates in China.

            Two months before the July flashcrash, Markit reported to self trading customers that stock holdings doubled. Two days later, the customers holdings returned back to their correct number. No explanations were sent by the Firms to customers. Nothing was said in the news.

            Let’s be clear, media is not a barometer of the world’s temperature. Media is a symptom of what comes across an editor’s desk or email Inbox. End of story.

            The NYSE was the target of the Flash Crash, as was the Wall Street Journal, and United Airlines. The Chinese and/or Russians were blamed. Might as well have blamed the Pandas at the National Zoo. Masking tools like TOR developed during the Clinton Presidency allow anyone anywhere in the world to pretend to be anyone else anywhere in the world. ICANN’s glut of domain names allows anyone to squat and use anyone else’s name for an appearance of legitimacy. George Soros sued Piotr Tutro in WIPO’s Arbitration and Mediation Center, Case number D2008-1792. Tutro lives in Warsaw Poland. Soros is infamous.

            Interesting that on Wall Street only the NYSE was hit.

            The NYSE, New York Stock Exchange has a history.

            Cops teach to follow the money.

            The NYSE is tied to the NASD, the S.R.O. that preceded F.I.N.R.A. The public was told that the NASD ‘went away.’ The NASD may have but no one in FINRA, the NYSE or the NASD spoke publicly that a “new NASD” was created or that “NASD Holdings” is the corporate entity engulfing FINRA.

             In 2007, the NASD, National Association of Securities Dealers, merged with the NYSE to form FINRA, Financial Industry Regulatory Authority. FINRA is a business league, a private organization. Speculation is the NASD shut down because of the growing bitterness against the NASD by Investors harmed twice, by NASD member brokers and brokerages, and then again by the NASD Arbitrators decisions giving Investors back pennies on their lost dollars. The NYSE, New York Stock Exchange, wasn’t smelling like a rose, either.

                In and before, the 2009 mysterious Wall Street moves, strange things took place that were not reported to alert customers with life savings in Banking Institutions. No one told the consumers that November 2008, the SEC began investigating RBC, the Royal Bank of Canada, for behaviours of the Bank’s CA’s and RR’s.

            It took time to document that “they did.” Bernie did tell the truth, “they knew.” Legislators ran on rumor rather than fact. Months and years since focus on Madoff and his billions of dollars of stolen investment client monies. Madoff’s thefts started decade before Harry Markopolous public patting of himself on his back. Documented, decades earlier.

            In 2012, a  Bank customer learned that in 2010, their accounts had been digitally entered by another financial institution employee, a JP Morgan employee. JP Morgan was home to Bernard Madoff. Madoff alleged he used proprietary technology for his mysterious computing of client accounts.

        The J.P. Morgan employee’s name was all over 800+ PDFs of the Royal Bank client account statements and other documents. Screengrabs show 2 computer programs were used to create the PDFs- Xenos and A.D.P. A.D.P. is a program used worldwide with voting, too. The PDF signatures shows the PDFs were created after a FINRA DRS complaint was filed. The J.P. Morgan left working for the RBank in 2004, six years earlier.

        F.I.N.R.A. determined there was no crime to report to law enforcement. Oh, forgot to share, F.I.N.R.A. has taken on the role of determining if and which crimes to report to cops. Congress' writing of the Investment Act of 1940 didn't give law enforcement ability to S.R.O. There are some things, still, only cops can do like read Miranda Rights and 'book 'em Dano.'

        F.I.N.R.A. instead locks up crimes in their boondogle of A.W.C., Acceptance, Waiver and Consent.
       

        Mysterious moves kept happening in the financial markets largely not reported or underreported in a ‘news’ world where Kim K and Jay Z get more airtime than cash. Photos of cute kittens get circulated to millions throughout the world while Wall Street stories don’t.

         September 2010, SEC Chairman Mary Shapiro addressed the Flash Crash of May 6 at the 410th meeting of the Economic Club of New York at the Sheraton in New York City. Shapiro was a hire from F.I.N.R.A. F.I.N.R.A.  is the Financial Industry Regulatory Authority, an S.R.O. hybrid of the N.Y.S.E. and N.A.S.D., alleging to the Public that it protects investors. F.I.N.R.A.  cannot. .I.N.R.A.  is authorized by Congress’s Investors Act of 1940 only to engage with brokers and brokerages. F.I.N.R.A.  made the giant leap in to the investor’s pool, not publicizing that F.I.N.R.A. takes payments from brokers and brokerages hence F.I.N.R.A. cannot be neutral with investors.

        F.I.N.R.A. facilitates Wall Street crimes being kept quiet. F.I.N.R.A.  doesn’t tell the cops. Law enforcement could determine that F.I.N.R.A. is an accessory to crimes after the fact.

         F.I.N.R.A.  poses as a regulator, like an F.T.C. or F.C.C. or S.E.C. F.I.N.R.A. is not a regulator. F.I.N.R.A. is an S.R.O., self regulatory agency that must apply to the S.E.C. for approved status as an S.R.O. The laws Congress wrote allow for many S.R.O.s. The S.E.C. is staffed with many former F.I.N.R.A.  employees. F.I.N.R.A.  is the only S.R.O., the wolf in the investor chicken coop.

         Flash crashes were ‘a test,’ make no bones about that.

          Financial institutions are quick to blame China and Russia despite documents showing the name of J.P. Morgan’s global money movement employee’s name in another Bank’s accounts.

         The S.E.C. multi-state investigation in to RBC Capital Markets LLC was started because of a tip 6 years before the ACO’s, the Administrative Consent Orders hit the internet.

          Some state’s ACO’s acknowledge their state’s action was regulatory only. A regulatory action is often just a civil slap, accompanied with the words “Without confirming or denying.” Each of the 49 commutations President Obama granted were given to people who were not given the luxury of “Without confirming or denying.” These men had to plead guilty and/or were convicted of guilt. Congress set up regulators neutered of abilities to convict and incarcerate big money criminals.

            Some of the ACO states provided their constituents the ability to sue the Royal Bank. Neither the SEC, local security commissions, respective state Department of Corporations or from RBC Capital Markets LLC itself. one thought to tell the customers. No one wrote an Order that demands the Royal Bank tell the customers by certified mail or by online account portal ‘click’ acknowledgements, albeit, 6 years after the multi-state investigation had begun. Statutes of limitations continue to roll. Statutes of limitations that are missed add to the ‘win’ of the Bank’s paying a ‘penny on the dollars’ regulatory fine.

            No one told the clients at the get go of the Bank being investigated, giving clients to remove their funds to safe harbors. No one is warning clients of Markit.

            Markitondemand is Registered to Ascio Technologies Inc. in Denmark. Ascio Techologies Inc shows a related entity in Colorado. American GTLDs, the (dot)com or (dot) whatever are supposed to be registered through ARIN. ICANN, the controversial Department of Commerce entity, is responsible for assuring the correct register is registering the correct country company. ICANN stands for Internet Corporation For Assigned Names and Numbers. ICANN wants to remove American taxpayer funded IANA, Internet of Assigned Names & Numbers to Switzerland, rather than start its own. Data is the most likely reason why. ICANN took over the role of ARPA then DARPA, military entities that had been already aggregating global decades prior to President Clinton’s 1998 orders to form NEWCO. NEWCO was the working name for the entity that became ICANN.

            IANA data is gold. ICANN has shown that in quadrupling the non-profit ICANN’s profits in 2 years of domain glut online.

            Markitondemand shows a Boulder Colorado address. Markit’s parent group, the Markit Group Limited is quartered down on Ropemaker Place in London. American investors private data is accessed by nationals of a foreign country, something undisclosed to Investors told by their platform host, Markit is a tool to guide decisions they make.

           Wikipedia disclosed Markit better “Markit Ltd. is a global, financial information and services company with over 3,600 employees, founded in 2003 as independent source of credit derivative pricing. The company provides independent data, trade processing of derivatives, foreign exchange and loans, customised technology platforms and managed services.           Bloomberg reports “Markit Ltd. reported unaudited consolidated earnings results for the first quarter ended March 31, 2015. The company reported revenue increased by $12.1 million, or 4.7%, to $271.5 million for the three months ended March 31, 2015, from $259.4 million for the three months ended March 31, 2014. Adjusted EBITDA was $120.7 million for the three months ended March 31, 2015 increased by $4.0 million, or 3.4%, from $116.7 million for the three months ended March 31, 2014. This growth was driven by the Solutions and Information segments, offset by a decrease in the Processing segment, and reflects operating performance as described above.           International Organization of Securities Commissions used to be Montreal based. Currently, ensconced in Madrid, Spain, the International Organization of Securities Commissions warns of ICANN’s glut release of “financial” sounding GLTD’s criminals are already hiding behind. Dylann Roof walked in to a South Carolina church. He slaughtered 9 innocent people we would all be considered lucky to have as friends. Since then, a South v North battle has been revived. First the call was to take down the South Carolina flag at the Capitol. Now the call is to take down the Washington Monument. Parts of the Jefferson Davis Highway are renamed the Jeff Davis Highway. Calls are out to remove the Confederacy from any place that someone says ‘it offends me.’

Maybe the call should be to stop the offender. No. Not Dylan Roof, he is in Jail. ICANN, set to testify before Congress this day.

  Without ICANN releasing domain names, without IANA the at controversy tax payer fund created entity that ICANN and interested parties want removed by September to Switzerland where it will join the UN family of organizations that are pushing for 1net.org and 1 world, maybe this would not have happened. A twenty year push to remove IANA from America had begun. Postel's hijacking attempted to stop what vested parties hope will take place by this September. Alot of money is at stake. Billions. A world is thrown in to chaos by a technology America created in the military.

Without ICANN’s failure to oversee IANA, most likely the murders in the Church in South Carolina never would have happened. Dylan Roof does not live in Russia. Dylan Roof’s ISP should have been domestic, American and closer to home.

LASTRHODESIAN.com does not exist in a vaccum. It is a .com not a trademark. It exists online. It has a domain name, a URL. Domain names are managed and marketed through ICANN, the Internet Corporation of Names and Number.

Several stealth projects were under Bill’s watch. IANA was one. TOR was another (www.centerforcopyrightintegrity.com- search TOR) . ICANN was a third. ICANN was set up in 1998 as Newco. Several entities vied for being the Newco. The bid went to ICANN. Esther Dyson was involved. Dyson has been quoted saying the current ICANN is not the ICANN of 1998.

Not everyone was exuberant over commercializing use of IANA. Jon Postel, its ‘dad’, was very concerned, enough to one night turn 10 of ICANN’s 12 servers away. Postel had done something the Oval, office was angry at. Postel showed ICANN was not secure. Postel showed that IANA was insecure. Postel hacked IANA. Then Postel was dead.

A lawyer for Newco aka ICANN presented testimony alleged to be Postel's. Congress will never know. People who knew Postel knew he was not for profiting from IANA, this being his reason for hacking the government, angering people pro profiteering from ICANN still to this very day. Former colleagues of Postel will carry his photo to meetings, introducing Postel's pic, upside down.

What is IANA?

IANA is the warm and fuzzy that converts the cold numbers of ISPS in to numbers. People remember things we like more than we remember numbers, hence the plan was to let people bond with Domain names. Now the push is to get people to bond with GTLDs, customized stringing of domain endings ie. .Dog.Ate.The.Cat. Because.He.Hates.Cats. Kids.&.Everything.

It is a lose-lose situation for people trying to protect brands, identities, trademarks and people in churches.

Almost immediately after landing on Site Apple, Person A’s ISP has been stolen, conscripted according to presenters at State@Tech held at GWU while Mrs. Clinton was Secretary of State. Money was being given to groups to create Underground Railroads of the political intervention world. This is the question that must be asked of ICANN. Congress has this opportunity. Fadi Chehade comes to Congress to politic. Chehade is the ICANN CEO called to the witness table while ICANN's Steve Crocker's sits in the seats in peripheral view, for guidance of Chehade with a slight twist of Fadi's head.

Fadi has testified before Congress that ICANN could not be hacked. Then ICANN was hacked. The site, hosted by NSI.Hosting.Reg.Ru, was last updated Feb. 9, 2015.  RU is Russia. The domain registrar https://www.reg.ua/ is the same registrar as https://www.reg.ru, still Russia.

Identity of the site administrator is protected by the Tech Organization Privacy Protection Service, Inc, doing business as Privacyprotect.org.

The connection of Roof to Russia in unclear.  lastrhodesian.com is not registered to Dylan Roof is clear. This site may have had photos of him on it. The connection of Roof’s site to Russia is very clear.

The EU is taking legal action against Google.

Google is accused of abusing its dominant position in search to direct the unfairly direct the public to Google’s services. The matter is characterized to be about shopping. Competitors like YELP! cite unfair advantage.

No. It’s dominance. Deceit. And dangerous.

EU isn’t fighting the last war. EU is fighting the first war. The clock is ticking. At root core is IANA. IANA is the Internet of Assigned Names and Numbers, caught in a struggle between Legislators ill prepared to grasp this grab going on for decades. Legislators are caught up in exhaustive whack-a-mole attempts to crush problems with regulatory address. Regulatory address is simple- the Googles wrists are slapped for low level dollar fines that you and I go to jail for.

The Googles don’t. They go to Davos. Or to the Caymans, Ireland, Switzerland.

The world bought in to the myth Google was developed by two Stanford students. Google went “live” days before ICANN formed. Google began decades earlier. Two students figured a way for academics to talk back and forth between institutions. The student charged with oversight was determined his IANA would not be used for commercial purpose.

And then he died unexpectedly. Jon Postel isn’t respected at meetings of the Old Guard he showed up pointing DNS servers in wrong directions. Today, what Postel did, is called hacking. Then? Postel became a scourge, “honored” at public events but at insider events, Postel’s photo is held upside down.

Postel was days out from delivering his Congressional testimony before dying suddenly. Someone else gave a speech, they alleged was Postels.

American Legislators with investments in the movers and shakers companies of Silicon Valley, are rushing legislations through Congress impacting the world. Behind the crush to destroy global economies, are the Googles’ lobbyists. Their job is to eat lunch, grip and greet, show up at parties delivering talking points. Ask them if they know Postel or how the Internet began. No. Many are not old enough. The Old Guard are busy drafting legislations to remove IANA from America.

The EU isn’t happy. They just don’t know what they should be livid about. Legislators and staffers and even Parliamentarian investigators, globally, don’t dig deep in to documents. Lets be real. Too much is going on. Everywhere. At once. No one knows who is watching, snapchatting, TOR-ing, or Googling.

The privacy issue the EU is angry over is more disturbing than they imagine. Search results are directed where the Googles want the search results want them to go. A search for infringements by an infamous manufactured celebrity blogger produced 6 hits in the Greater Washington are. The same search, in Europe, produced 36 hits. Same name. If the name was run in Namibia or elsewhere? Results would be different again. Then again, if you and I told someone we want money from them before we sell it to the highest bidder? We would be incarcerated for extortion. Or kidnapping. But the Newco Google was part of? Acquiring or funding "start up" after start up? It gets away with calling their baby "bells" (for those who remember AT&T).

As I explained to Aussie legislators the other day, no one has enough money in the world to protect privacies anymore. Taylor Swift’s purchase of .sucks, .porn, .xxx is not enough to protect her brand, not when the products being sold are .bad.music.horrible.singer.sucks, the possibilities are endless. No one has enough money in the world to protect themselves. No one.

Not even Hillary can protect her name or George Soros. Both of them have taken the persons that bought their identities to the International DRS, dispute forum, WIPO, operating under the United Nations. The disputes have exploded from a few a quarter being reported to countless, too many to count. Not enough legal staff of the entity to deal with. But that is the point. The entity, the ICANN, that Google was part of at its beginning and now involved in with Charleston Registry and other pseudo names. No one knows them all. No one ever will. The technologies, hiding the personalities orchestrating this global chaos, we see them emerge as Google Glass. DC insiders know Google Glass was a military technology in origin. So is, the Google.

So that’s where it stands. Almost.

The EU is angry at Google. The EU and the world that jumped on the I.O.T. bandwagon as the next best thing are learning the hardway, everything we thought was private is being held. Facebook is letting peoples decades on Facebook come back out as “memories.” Google? Well, everyone knows that “deleted” is a “click” and not a reality. The I.O.T. has turned out not to be the Internet of Technology but the Internet of Thieves.

The spaghetti technique of throwing money at everything hasn’t worked. Ask SV insiders. Ask the SBE. The people making money are the people hoarding data or offering Meet Ups and Classes almost as expensive as college classes but without scholarship or grants. Conferences are banging up Big Bucks as tourism sites dangling the same ol’ speakers. Parties only go on for so long.

The analytics of Comments, Shares, are not adding up. America’s entrepreneur report has not been issued since 2010. 2010 the US gave dollar for dollar matching money to Venture Capitalists without a need to repay. Sweet deals. Groups biggest customers are governments trying to cover up that things aren’t working. Jobs are being lost left and right. A SV insider answered the question “how long until the bust”, he says “a year.”

So there you go, the EU is going after Google. The EU and other countries need to go after the United Nations pushing this connected Internet as part of their ITU agenda. Say the words, Agenda 21, people turn away. One cannot ignore the UN is behind WIPO and now wants ICANN the NEWCO that Google was part of decades ago. Legislators werent watching. Most were in over their head when they got in to office or beginning their run for their next term or delivering speeches using party politics to cover complicity.

It stopped being about the people along time ago. It began being using the people as commodities, bought and sold, new world en-slavery.

There is more. Isnt there always. So what about the EU. Do your diligence. Google is anti-trust, union busting, trademark destroying, Copyright stealing, privacy infringement, trafficking humans, after all isn’t that what it is when people are sold over borders, as we all are by the entities based out of Germany, France, UK and other countries, aggregating peoples around the worlds lives.

EU going after Google is not enough. UBER is Google. Google is Charleston Registries. And so many other entities it will make your eyes cross. Shut the UN down. It failed as the League of Nations. It serves no purpose now. How is that Peace Maker thing working? Just replay Ambassador Samantha Powers talk to AIPAC a few months back where she listed kidnapping, wars and conflicts current in our world today.

Legislators getting it? Not at all. If they did, they would figure out that TOR started under State hiding conversations and stealing identities to create conflict under innocent persons’ ISPs. The EU needs to read what the Afrinic community has been writing about ICANN. And the EU legislators have to have big brass ones because as whispered inside the Beltway, public persons who shut down fast on political and trade positions they take, are rumored to have secrets that are ripe to be outed. All of those grip and greets inside the Beltway, Parliament, global governments are photos some wish would go away, knees quaking their secrets on line, like Petraues’ will be outed.

An interesting convergence is happening.

In a matter of speaking, the rubber is hitting the road in the matter of ICANN or as others might put it, ICANN’s push has come to shove. ICANN, ordered to produce papers pursuant to a DC Court judgment, claiming that domains like Iran’s .r domain, being sold by ICANN for $185,000 with an annual $25,000 maintenance fee, have no value.

ICANN claims it, a “non-profit” the Feds-ICANN constract state ICANN was deemed by the US government, is not accountable for others crimes. ICANN says the US government is accountable for ICANN’s doings. ICANN is under contract with the Feds. ICANN’s contract written in 2000 was 8 pages long. ICANN’s contract written in 2009 is 32 pages long. It is more more like a .com Domain Bubble about to burst as ICANN is coordinating, during its LA Conference, the role out of .dot everything even .(script) everythings. New York City is hustling .nyc . Soon Shultz's .ebola.com  will be competing for sale against .ebola, .ebola.au. With the plan ICANN is rolling out at its Los Angeles, Ebola will be everywhere in the GTLD world. Schultz's (dot) disease domain will be eradicated. If only eradicating Ebola was that simple.

ICANN recently rolled out, for sale, a slate of ICANN domains that ICANN told the DC Court Judge have no value. ICANN’s affiliate contract says different. Registrars are required by ICANN to keep in force “commercial general liability insurance with policy limits of at least US $500,000”. Other ‘short leashes’ include not being able to sell ICANN’s Accredited Registrar logo or from otherwise representing itself as accredited by ICANN,” or ICANN having the right to terminate Agreements, not the US Government ICANN told the DC Courts is accountable.

Why termination?

Reasons given include material misrepresentation, material accuracy, misleading statement, 5.3, Termination of Agreement by ICANN, 5.3.1 or 5.3.3, “Any officer or director of Registrar is convicted of a felony or of a misdemeanor related to financial activities or is judged by a court to have committed fraud or breach of fiduciary duty or is the subject of a judicial determination that ICANN deems as substantive…” (

Where does Iraq, Iran or even .ru come in to play here?

Hold tight…. Hover offers almost 400 domains through ICANN. Asterisked domains come with an FYI. The FYI says “* Some TLD’s require an 18 cent ICANN fee added before checkout.” Some of the 18 cent ICANN fee taxes include .church, .wtf (yup), .press, .aero, .ac, .accountants, .wtf sells for $22.60, .xxx sells for $65.86, .aero sells for $78.81, .ac sells for $79.99, .accountants sells for $69.98. Marked “SALE” are .club, .me, .co and .info. .org and .com are selling cheap, $10.99 but are not on sale. .uk and .us are selling pretty much bottom of the barrel for $9.99. So much for America leading the world. There are different costs for “transfer in”, “registration”, and “renewal.” Some of the costs from “transfer in” to “renewal” are incremental.

The pricey TLDs provide a picture of where our world’s head is at. .coop sells for $199.81, .creditcard sells for $103.97, .investments sells for $69.98, .io sells for $79.99, .loans sells for $69.98, luxury comes at a cost of $414.00, .press sells for $68.95, .sh sells for $79.99. Travel? .travel goes for $88.81.

Tragic isn’t it when .us and .uk, allies in commerce are sunk low, so low. Wonder now how ICANN is going to explain, again, to the DC Judge how domains have no value. I cant wait to hear Fadi Chehade, ICANN’s CEO, explaining to Legislators where all the TLD money is going to. Now, mind you, this almost 400 TLD list is just what Hover posted for clients and potential clients to peruse. Multiply the almost 400+ TLD’s times all the other TLD’s ICANN, the ‘non-profit’ is hustling around the world, America’s debt worries would be over. All the immigrants from here to eternally could be paid for, billions, and then some. This is what the US people are being robbed of.

A little bit of housekeeping first. Some crackerjack forensic boy lawyer not working for Congress or ICANN will have to go ICANN’s contracts issued in 2000 and then in 2006. Something in the 2000 contract said the US government has to approve all fees, changes and yada, yada. This will be fun, IRS.

Respecting ICANN’s intent to move IANA to Brussels or wherever, as long as IANA is in the USA, there is something about ‘separation of Church and State...’ Selling .church may be verboten. Something to think about… oh, yeah, and ‘.blackfriday.com’ America already had the Redskin issue. Probably not a good GTLD to sell, moving forward. Somehow, guess is Congress is going to redline a lot of the GTLD’s IANA, America’s company has been approving under the wire. Hey. What can you do? Congress cant be everywhere. That said, Congress does cut deals in good faith with unsuspected Bad Actors.

Congressional Research Service issued a White Paper October 28, 2009, “Internet Domain Names: Background and Policy Issues.” Lennard G Kruger, a specialist in Science and Technology Policy called ICANN a “public benefit corporation” (Page 3). Kruger wrote in “ICANN Basics” that Internet explosion “led to a marked growth of the ICANN budget, from revenues of about $6 million and a staff of 14 in 2000, to revenues of $60 million and a staff of 110 in 2009.” Kruger wrote, “ICANN (not the Federal Government) is funded primarily through fees paid to ICANN by registrars and registry operators.” Kruger continues “In 2009, ICANN is receiving 92% of its total revenues from registry and registrar fees (41% from registry fees, 51% from registrar fees.)” (http://fas.org/sgp/crs/misc/97-868.pdf)

ICANN provides domain names under which lewdness is promoted on line, hatred and racism are incited, torture and beheadings are broadcast globally, theft of personal property such as ARTS Content is disseminated globally unable to be tracked because ICANN’s cohort sets up firewalls, of sorts, blocking search results to track for example naked photos of Hollywood celebrities deciding to shoot Home Porn.

ICANN claims the US Government contract gives ICANN clean hands in business dealings with IRAN and possibly, other entities US law forbids business dealings with, suggesting the US Government is guilty of these crimes ICANN is refusing to produce documents on pursuant to the DC Court’s order.

Oh what a tangled World Wide Web is weaved when one is attempting to deceive.

U.S. District Judge Thomas P. Griesa in New York ruled that Grooveshark, the streaming music service based in Florida based company and its co-founders infringed nine record labels' copyrights, intentionally, UMG Recording, Inc. v. But Grooveshark did not do its crime alone. Grooveshark had help from others in committing this Intentional crime. Grooveshark has “conspirators.” Grooveshark would not have been found online, responsive to Searches, without Google and other search engines,. Grooveshark’s co-founders would not have had their online Alias, their Domain name “grooveshark.com”, without ICANN.

ICANN says without its US Government contract there would be no ICANN which means according to ICANNN’s explanation that the US Government has gone in to the business of selling “.wtf”. The US Government responsible for ICANN that is selling .xxx (porn) and ‘what the f_ck’, according to ICANN’s DC Court pleadings? Really?

ICANN is a week out from its Los Angeles Conference.

There are galas in each city ICANN hosts its “governance” conference. There will be no gala in LA. Speculating? The difference between LA and London and Istanbul and…? Legislators proximity to attend. And the IRS. Legislators may show up, would question ICANN’s gala opulence. And at the same time ICANN is accountable for global theft online of IP, and global incitement of hate, increasing beheadings, etc. Without identifiable domain names, the Internet would be a mess of numbers. Without domains, Bad Actors would have fewer places to ie show beheadings to diners. As for the IRS? Love ‘em, America’s pitbulls.

With all the privacy issues tearing at Google at this time, one would think legislators would connect the dots on Do-Not-Let-IANA go out of America. There are far too many questions besides, European Governments are challenging Google and other Internet Providers with Privacy  crimes. ICANN wont cooperate with court orders in America.

Without domain names then Internet would be a W, W, W world of ISP numbers. Names make numbers warm and fuzzy. The internet of names with the like  “kike.com”, “Cunt.com”, “F**.com”, “nigger.com” albeit “nigger.com”, are facilitated through ICANN. ICANN sets up domain names each daily. “nigger.com” approved by an ICANN Registrar was bought by the NAACP. A lot of domain-ers did the same, even buying .org, .net, to protect brands or to prevent abuse. With the rollout of almost 400 new GTLD’s, and more to come, soon after Dan Snyder’s “Redskins” brouha,  not even the NAACP has that much money in its world. ICANN does. ICANN is making money. GTLD’s cost $185,000 the $25,000 to own.

Congresswoman Zoe Lofgren, back at the March 2014 ICANN hearing in the House Judiciary, announced she would fly to an ICANN meeting nearby, on ‘her plane.’ Question to ask is was Zoe invited to attend ICANN’s conference in Century City, October 12-17. ICANN didn’t do the greatest of jobs getting word out to Legislators. In fact, on home turf, ICANN isn’t putting on the glitzy gala ICANN toasted with in London. Most likely, to avoid legislators seeing how taxpayers monies are spent. ICANN is safe. Legislators rely on staff to do diligence when it comes to research. In a world of beheadings, stolen naked celeb pics sold around the world and ebola, ICANN is low on the totem pole, almost as low as FINRA, equally unknown. Youtube videos and photos of ICANN’s galas past are plastered everywhere. It is the IOT, after all.

Any wonder of anti-american animus after this meeting is exacerbated by ICANN itself, its minion, Keiran McCarthy, leading off the rumor from ICANN’s blog stating the US government is letting ICANN go. Really, ICANN? Misleading global governments is no way to build trust in with the government ICANN is trying to pry IANA away from.

A lot of money is at stake. Billions. Things are getting hotter, for ICANN that is.   

ICANN is the Internet Corporation for Assigned Names and Numbers, with “stewardship” of ICANN is pushing to “steward” IANA out of American control. IANA, a cash cow, a billion dollar cash cow, was funded with American taxpaying dollars. US government contracted with former NTIA employees in 2000, Steve Crocker and a few cronies with a tad of a tall tale being told. Vint Cerf, one of the ICANN cronies, claims he built the Internet.

Vint Cerf did not build the web. Sir Tim Berners-Lee did. ICANN was incorporated, 1998. Berners-Lee warns the US government against letting IANA go to ICANN. Congress needs to call to testify Sir Tim Berners-Lee, the man who proposed created a global hypertext document system so researchers could put information online where their colleagues could find the info, at will, any hour, any day. The year was 1989. Cerf, vice president and chief Internet evangelist at Google, is the current chairman of the American Registry for Internet Numbers and former chairman of the Internet Corporation for Assigned Names and Numbers (ICANN). Vint Cerf worked at NTIA, the National Telecommunications and Information Administration. Jon Postel created a ‘phone book’ for domains. One column has the ‘phone’ number. The other column has the corresponding name. Jon Postel, then at USC, worked out this ‘phone book’ of ISPs and names idea. Life was simpler then. 5 GLTDs. Things changed. The Internet is getting nastier.

ICANN is explained simply.

People create websites with domain names that insult, host stolen property, show of body parts doing things in position one would maintain should be private. Beheadings, bestiality and Walmart shoppers backside couldn’t be aired over the Internet without ICANN domains. Website and blogs with pictures of  the exposed naked selfies shot by Rhinna, Kim Kardashian, Anna Kenrick, Jennifer Lawrence are on sites with their domain named managed by ICANN. Payment is taken in Bitcoins. Bitcoins are a currency that don’t exist, physically, that is. Persons robbed of Bitcoins are, oh well, screwed. Stolen Content sold on other than owner’s websites, or Etsy shops, need ICANN domain names to do so. Oh yeah, the State Department funded it, TOR Project, that is (https://www.torproject.org/about/sponsors.html.en) ICANN decides what names may stay up and which should come done.

Hatred and abuse and theft online can be stopped. Litigation in America will decrease. And, likely, some people would go to jail. ICANN must obey its court orders. 

ICANN is refusing to turn information to Shurat Hadin Law Center, on Iran’s top-level domains and Syria and North Korea domains to terror victims over to a DC Court, ICANN Court Filings, Case 1:01-cv-01655-RMU, Document 106-1, filed July 29, 2014. Darshan-Leitner, Israel’s arguing for the victims, wrote “ICANN could “pull the plug” on Iran’s Internet, suspending use of the .ir domain and disconnecting Iranian IP addresses from the web.” 

Jones Day, attorneys for ICANN argue “ccTLDS are not property subject to attachment…. Not “owned” by the countries to which they are assigned… relevant ccTLDS are not within the District of Columbia or even in the United States” and that ICANN “does not have the unilateral power or authority to re-delegate the ccTLDS and doing so would interfere with contractual relationships” and that “forced re-delegation of these ccTLDS would destroy the value of the ccTLDS, the rights of the domain name holders and jeopardize the manner in which the Internet operates.”

Law firm Jones Day states ICANN has a contract with the US, albeit badly written with few protections for IANA’s ‘investors’, the American people, crowdfunding the Feds program. The US District Court ruled that those fees, along with the assets themselves, could be used to satisfy the Iranian debt to the terror victims plaintiffs. Included in the judgment are all the “top-level domain” (TLD) names provided by ICANN to Iran, including the .IR TLD, the Persian-language ایران TLD, and all Internet Protocol (IP) addresses being utilized by the Iranian government and its agencies.” (http://www.israellawcenter.org/page.asp?id=&show=photo&pn=1494&ref=report)

IANA was to transfer to a private company. ICANN is a non profit. Confirming if the US Government intended “non profit” when the Government contracted with ICANN, a fine point to argue. It is a point still, at that. ICANN’s exposure for Asset collection is minimal. ICAAN’s LA offices are rented. ICANN own’s new headquarters in Brussels. ICANN is exposed. It is predictable that the families of the beheaded journalists and aides workers will sue ICANN, too. Cerf and Crocker are at risk for being sued personally for the beheading of the Americans and Brits being shown through a Domain Name approved by ICANN. Multi-stakeholders and shareholders and lawyers around the world will learn that being a volunteer does not exempt one from liability. Being a board member comes with accountability.

ICANN claims publicly it is about transparency. Cerf and Crocker are not transparent. Names of participants are not posted on Listserv’s line or shared between stake-holders. ICANN 51 Los Angeles attendee list provides an opt-out option for those attendees wanting anonymity. ICANN’s is threatening to lock up data for ICANN WHOIS.com participants. WHOIS.com  is a resource for Process servers, journalists, investigators and persons wanting to serve take-down notices on Intellectual Property thieves.   

Get a very clear picture of ICANN, arguing both sides of the fence depending upon wh and IANA? Think of the online rash of beheadings of Americans and Brits, if not the actual photos, the head being shown mid neck slit or after being lopped off with bodies falling to the ground, the decapitated head in hand. These would not be able to be shown by a hate group if someone or some group was not able to buy a domain name.

ICANN argued in a DC Court, the Internet is on loan from the US government with only the US Government having authority to provide that sought information. The Darshana-Leitner Law Center may have standing to sue the US government, even bringing it to the Hague on War Crimes for allowing ISIS to exist online and for allowing That may be all American legislators needed to hear to cancel IANA’s transition out of America. Or in the least, to review ICANN’s contract with the US government. Maybe even cancel it. ICANN has 13  root servers. 10 are subject to US law. Attorney Dr. Behrooz Akhlaghi reflects Congressman Tom Marino’s concern that “ICANN will be replaced by an as yet unestablished international group.”

Theresa Swinehart, Senior Advisor to the President on Strategy, said, “NTIA announced on March 14 2014 that they are planning to relinquish their stewardship of the IANA functions to the multi-stakeholder community…”. That is not true, yet, if ever. NTIA has to go through Congress first. Legislators isn’t buying Fadi Chehade’s testimony, either. Neither are other government officials around the world. What Congress needs is a Global Congressional Conference call with all parties come together at the same time at a theater near you. Call Comcast. Call Seacrest. Call Andy Cohen. Call Simon Cowell.

  ICANN put out a call for opinions on paying Board members, including proposed Bylaw revisions that would “allow non-voting Board liaisons to accept compensation if approved by the voting Board members.”

ICANN continues to put the cart before the horse. Keiran Mccarthy’s News Blog on ICANN is prime documentation of the overstepping of latitudes ICANN exhibits. McCarthy posted March 20 2014, “In an unexpected move late last week, the US government announced it would transition the IANA contract to ICANN in 18 months time.” There are steps that must take place before a statement like that can be released as a done deal before Congress approves, unless, this will become an Executive Order overriding Congressional oversight.

The question is WHY, what is the rush? The answers legislators asked of Fadi are not answered, still. The push to move IANA off away from American oversight may be a decade old battle, for the people, though, who had this as their agenda in mind all of these years. It is not a decade old battle for the 2.8 million, and growing, Internet Users that Chris Mondini, ICANNs new from LA to DC man sent to drive this agenda home and fast. Why?         

 Driving IANA’s move from America overseas, consensus is, being driven by Steven Crocker. Crocker understands business, success and disclosures with his involvement back with IANA in the days of Jon Postel and currently as the founder of Shinkuro.

Disclosures must be made about 1net.org set up in October 2013. Why? What does it get out of IANA being moved away from America.

A lot of questions need to be answered before discussing Compensation for Board Members. Putting compensation for Board members and non board members approved for compensation by the Board is a tip to what IANA’s rush away from America is.

There are a helluva lot of “I”s that need to be dotted and “T’s” that need to be crossed before compensation is discussed. American legislators have got to man up and start acting like the business people they are supposed to representing American constituents before they let IANA move out from under their control.

Questions to get answered include, in America- ICANN is a non-profit with over $77 million in the bank. Where did all that money come from? How is all that money being dispersed. In fact, it would make logical sense to have a forensic team review ICANN’s form 990 filings to make sure they pass the smell test, so to speak. $77million is the non profit filing for America alone, not addressing all the other “Stakeholders” ICANN has employees and offices in globally. The Legislators must demand a time line of people involved in ICANN along with a Family tree to due diligence as to who these “Stakeholders” are, their backgrounds, etc. This deal should be no less frightening than American life being slowed with Identity checks, TSA at airports, etc. The better question still not answered is what is the rush?

The system is working.

As a freelancer impacted already by technology’s infringement of my Intellectual property, I want to know who all these people are and want to know if IANA is such a phenomenal idea they believe in, then do like I have done all my working life, you work for free with your investment making the payoff, not getting paid first without a performance clause that must be met. Legislators must demand to see the contracts that are going to be provided to the Board Members and all others, in that definitions of “non profit” vary. The woman on the plains in the Midwest leading a Church Group’s definition of non profit expenditures differs significantly from, for example, FINRA, operating in America as a non profit, too.

There are 29 different categories for Non-Profits under the IRS, so “non profit” is more than just the word as it is tossed around blithely. What kind of a Non profit are the compensated people sitting on? FINRA lists itself as a Business League and as a Business League, FINRA the non profit allows its Board Members to be compensated for First Class travel, travel with a spouse, memberships at sports clubs and compensation for chefs, chauffeurs and valets. Is that what ICANN has in mind for IANA Board Member compensation too? A list of these people who become the proxy for America’s voice overseas, needs to be provided to Congress along with their bios and histories and their Aliases, online and off, giving Legislators and watchdog groups a chance to sink their teeth in to the WHO of the people running ICANN today not the WHO that ICANN started out with as a good idea. Simply, if you have been around as many events as I have in my time in DC, you get to learn the difference between young people starting out with ideals and the old people they turn in to with Legacies they want to leave behind. Legacy is what kills people, countries, economies and innovation. There is no room for Legacy in the potential cost to Americans by moving IANA away from American oversight, without which, the bad actors will never be ruled out. In these days of the Internet, America wont even see the Bad Actors coming- Snowden, the brothers who blew up Boston's marathon, need one say more. Demanding accountability rather than a promised Transparency is a good start, details all of which should have been provided to Congress before the Hearing Fadi testitied at. 

What is Fadi getting paid? How much is Steven Crocker making off pushing this matter to the goal post he intended a decade back? If they dont provide these answers along with checks, pay stubs etc, then the deal is over and Americans are saved yet another Solyndra or Benghazi or such. And if they dont provide these documents withint 24 hours of the request, then, any good investigator will tell you something is getting cooked and it is not a goose.

As one of the 2.8 million “stakeholders”, and growing, IANA says it is listening to, then the Contracts for the Board Members, non profit filings, etc, must be filed, in the least. Should it happen period, IANA transferring away from America, there must be accountability. There is non apparent at this time. There is nothing stating that all issues involving Americans be resolved in their home state and NOT under Arbitration. Forcing Arbitration is Un American. And forcing an American who can barely make rent, have a matter adjudicated overseas is unconscionable.

Look, ask anyone in and around the IP circles how all this one world nonsense is working and you get some pretty straight answers as to how bad things are going to get. The question I asked the lawyer involved in drafting that legislation was "what currency is the Unitary Infringed Patent going to be compensated in. He said, full audience, I dont know. We didnt think of that. I did. And I ask that question here, what currency will the multistakeholder Board Members be paid in? Bitcoin? That in the affirmative alone, is enough of a reason to tell American legislators to batten down the IANA hatches and keep it away from foreign shores.


While IANA’s move away from America, post the muddy death of Jon Postel 9 months after he got 8 people to point their systems where he told them to, is a ten year effort for the people now pushing to talk Compensation before nailing down security concerns, the reality is this has not been a ten year focus for the legislators and their staff being asked to field oversight on the move. Legislators come and go. Staff rolls over seasonally. There has not been the consistency on Congress’s part to know the nuances of the significance of what will go wrong. Their questions asked at the hearing are testament to that. Sometimes, watching a hearing is shades of watching the old show “What’s My Line.” The difference being, here, is Congress gets it wrong, American citizens lose.

 The question on every American’ lips should be, where do I “unsubscribe.”

The color of a conference is when a panelist respond’s with acid to a question they are asked. The moment is a Score when the panelist further responds with a Show & Tell.

Double score.

It was a rainy day in DC, beyond overcast. Late leave. Wrong train stop. Reverse then still the wrong train stop and a long walk doubling back. A mentor once said, if you’re going to make an entrance then MAKE an entrance. I did, drowned from rain that just had no intention to stop. I don’t do umbrellas. There is something purifying about rain just not the day and the way to walk in to a room of academics, moreso when your color sense, still, is California casual in a room of grey and black DC standard suits. Within a few of entering the room, I asked my questions I had quickly scripted soon after finding my seat.

Walking in to the room, I also had with me a printout from 1net-mail, talking about “Problem no.1” It says (11) it is uncertain whether transferring control would also include transfer of government property to a private entity….it is unclear if Commerce has the requisite authority to effect such a transfer.”- Philip S Corwin, Founding Principal Virtual Law, LLC.

In fact, a participant on the next panel, I learned, gave me insight that I was quite right in my question. What I had done innocently enough was rub salt in their open wound of a decade, that someone made them look bad. Not me. The man I named. I had reminded the panelists of a moment they were hoping to forget that no one would mention. The charm of being the new kid on the ICANN block is that I don’t know the sordid history the room teemed with. I was about to.

Break time, I was up at the panelists’ table, handing out my cards, asking for theirs. Names meant nothing to me. As I said, new kid on the block in the push for IANA to be taken from American oversight. The moderator wouldn’t give me his card. Counldnt find them, he said. His name was on the Agenda and Bios list. Tim Lordan. Instead, he reached to the table before him. With both hands he lifted a face down picture frame so I could see. I saw. It was Jon Postel, the man I asked him about that he responded to with a tick and sharp talk. Becky Burr, a panelist, gave me a brief history on Postel I did not know, not a comment against me. I had admitted when I posted my question, I just read about Jon Postel the night before, tripped across him is more correct, in doing so, answering a question Congressman Tom Marino asked at the ICANN hearing in the House Judiciary a few weeks prior. Marino asked Fadi Chechadi, CEO of ICANN, a few questions that resonated hopeful but not realistic- what guarantee could Fadi give, that Bad Actors would not overtake IANA putting American data at harm.
Postel I read on the world’s most trustworthy website, Wikipedia, known for its being a collaborative common effort of data presuming all data was correct, no data was promotional and that just because the requirement was to not violate the rules Wikipedia set out for being a participant, Jon Postel did exactly what Congressman Marino demanded answers of from Fadi Chechadi. Postel, according to the panelists I asked my question of, was a Bad Actor. Becky Burr, the Deputy General Counsel and Chief Privacy Officer at NeuStar Inc. told me she worked with Postel. It was a test, she said, a test not a loss of control, a test. Burr was unpolite, sharo, in her making sure I ‘knew’ that Postel was a “government contractor”, her words.

My thought? Postel, as I wrote earlier, was Snowden, decades earlier, and the reality of IANA not being secure for America, if offshored, as intended by ICANN in an unprecedented rush of an agency away from US Government oversite. Postel was every person who compromised security, and did the inevitable ‘this has never happened before and wont happen again.’ It has happened before. It will happen again. There are too many places and people without eyes on them. And like errant spouses who vow to love forever, sometimes forever lasts a lot shorter time.
Burr was on the second panel with Derrick Cogburn, associated professor of International Relations at the School of International Service at American University; Beatrice Covassi, first counsellor, Digital Economy, EU Delegation to the United States, Raquel Gatto, Chapter Development Manager the Americas, ISOC, Internet Society…, Christopher Mondini, VP Stakeholder Engagement North America and Global Business Engagement, ICANN.

I smiled wryly. I had seen “this” before, Government employees still ticked years later that a colleague did them a nasty, so to speak. Jonathan Pollard. Pollard’s colleague wrote a book about what went down in Pollard’s theft of Government secrets. The book talk was at the Spy Museum. Fitting.

 Few media were there. Me. A guy from Israel TV. That was pretty much it. The author talked, showed photos, diagrams without offering explanation how Pollard walked out daily with a briefcase filled with Top Level Secrets. Pollard’s colleagues were cream of the Spy agency, yet he, Pollard snowed them. The sneer of the speaker was rancid filling that evening. One man walked out daily for months maybe years with enough documents to equal the width, height and mass of a storage site. And they missed the signs. They failed at stopping him, similar to what Postal did.

An independent contractor, Postel convinced 8 of the 12 organizations that handled the entire Internet’s address book, to “reconfigure their computer servers so that the pulled addresses not from a government-backed operation in Herndon Virginia but from a machine at the computing facility he helped run at the University of Southern California. And they did.” (www.wired.com/2012/10/joe-postel)

Postel was showing the US Government they could not take control of the Internet away from the researchers that built it. Postel’s colleagues official word was Jon’s action was a “test” to “Show the Internet’s directory infrastructure could be repositioned as needed.” Others said Postel was “making a statement” to “show the White House that it couldn’t wrest control of the Internet from the widespread community of researchers who had built and maintained the network over the previous three decades.”

Timing? The White House was about to disclose it’s reorganization plan for governance of the Internet’s directory system. The year was 1998. The President in 1998? William Jefferson Clinton. Bill. The conference at George Washington University’s Elliot School of Business was 2014, a week ago. Postel was Edward Snowden before Snowden was in the Guardian paper’s eye.

 But Postel was a somebody with real time knowledge. Snowden had an agenda with no track record of accomplishments under his belt.

Postel was part of the USLA team that ‘set up the first node on the ARPAnet,’  from where the Modern Internet has morphed. Postel defined the network’s protocols. Postel was much more. As the primary administrator of the Network, Postel oversaw the documents that define the Internet’s operation. They are called RFCs, Request For Comments. Request For Comments are the Instructions of the Internet. Postel also oversaw the Internet Assigned Numbers Authority.

IANA. Sound familiar? It should. This is the same system Fadi Chechadi testified under oath, in to the record that….

Timing can be everything or odd in coincidence. Nine months after Jon Postel redirected 8 of the Internet’s root servers, Jon died. Cause of death? Complications during a heart operation. Here he was, at the IANA/ICANN panel, face down in a picture frame maligned by peers with sentiments against Postel running very strong, twenty years later, despite Postel being inducted in to the Internet Society’s Internet Hall of Fame, honored with Vint Cerf, Leonard Kleinrock, Ray Tomlinson and Tim Berniers-Lee.

Unnamed above is Steven Crocker. Crocker is the CEO and co-founder of Shinkuro, Inc. Shinkuro is a start up company focused on dynamic sharing of information across the Internet. An attendee at the conference was welcomingly blunt about Steve, describing Crocker as seeking Legacy. ISOC’s bio of Crocker says “He is also chair the Internet Society's Jon Postel Award committee and ICANN's Security and Stability Advisory Committee, and he is a volunteer Senior Counselor in the Office of the Chief Technology Officer in the District of Columbia, focusing on the District's creation of a new technology magnet high school.” Crocker was in research management at DARPA, USC/ISI and The Aerospace Corporation. He was vice president of Trusted Information Systems. Crocker was co-founder of CyberCash, Inc. and Longitude Systems, Inc.

Crocker was at UCLA when Postel was there, too. Crocker was seated in the House Judiciary benches when Fadi Chechadi testified before Tom, Judy and the other Legislators, not at the witness table where he should have been answering questions from the Committee.

Shinkuro Co. did not come up at all in testimony, that day. Shinkuro Co. did not come up during the GW pitch conference for ICANN adressing IANA. In fact, there isn’t much said about Shinkuro on its own website (
http://www.shinkuro.com/about.php). It does say that Shinkuro means “synchronize.” What is said is a repeat of Crocker’s bio on the ISOC website. One person is listed as Management. Steve. Crocker’s co-founder is not. The site says that Shinkuro is a US-based research and development company with a strong interest in information sharing across organizational boundaries, selling Shinkuro software. Shinkuro softward facilitates sharing “files across enterprise boundaries - securely. Just install the software on each machine, create a group and designate a folder you would like to share with the group. Any files you put in that folder will be shared with the other members automatically. Shinkuro also includes secure instant messaging and secure screen sharing, to give you a complete collaboration environment.”

Shinkuro, a privately funded company in the DC area, was founded in by Steve Crocker and Jeffrey Kay. Crocker is also involved with 1net.org (http://www.1net.org/). No. Nothing wrong with your asking what is 1net? Most cant answer. It is so new, formed October 2013, as, yes, yet another non profit. Quelle surprise… I guess there is cynicism in asking the obvious question of “How many non profits does it take before someone declares themselves to be profitable and worthy of taxing?”

1net.org is a twin or clone to the site of icann. Without facts, it is speculation as to their similarity of design. That said, many pages later,  the connection is drawn. Unclear, still? Who is Leadership? Who are Stakeholders? Who are their people around the world?

The year was 2002. This is 2014. There is an aspect of Crocker’s site deserving of compliments. Crocker writes “Shinkuro file sharing software contains cryptography and is subject to export control.” Shinkuro’s Corporate Office is located in Bethesda, Maryland. Shinkuro’s Development Office and meeting facility is located near enough by.

The site states, “You must agree to the following in order to download the software.”

The “following” that must be agreed to is the ‘Export Control Notice.’ The site says, “The software uses cryptography to protect the information you share using Shinkuro. Software incorporating cryptography technology is regulated by the applicable U.S. and foreign law. By accepting the terms of this Agreement, you acknowledge that software incorporating cryptography is controlled under the Export Administration Regulations and understand that you cannot export or reexport the software to any other user without receiving a license or other authorization. You also acknowledge that the Software is not intended for use by a government end-user, as defined under the regulations, or any entity prohibited under U.S. law. Prohibited entities include any end-user in a restricted country (Cuba, Iran, Iraq, Libya, North Korea, Sudan, and Syria), and restricted end-users on the Denied Persons List or List of SpICANN is not yet done evolving.  I don't know precisely what it will look

like in the future, but I am pretty sure there will be changes.

Crocker is on the Board of ICANN. Crocker, Board Chair, affirms the end of the US Government stewardship is  part of the plan that began back in the 1990’s, Crocker describes as maturation in the process (http://www.youtube.com/watch?v=eCvtvVZyjLA&feature=youtu.be )

Crocker in a letter to “Sally” said something else the Legislators asked about- the challenge of making a decision today for the people of tomorrow. Crocker wrote, “ICANN is not yet done evolving.  I don't know precisely what it will look like in the future, but I am pretty sure there will be changes.”

The agenda for Netmundial is buried deep down into their Principles. Cut to the chase, NEtmundials is another front in the attack on Copyrights & Identity ownership. While NETmundial “talks” about Multistakeholders, those impacted, further by the Internet are not mentioned once- the little people who lives and livings are decimated by the Internet Of Everything- theft of Identity and Intellectual Property online- the entities, the multistakeholders stealing what belongs to Legislators constituents- Silicon Valley’s, San Francisco’s brightest and best. Pew research reports increasing online thefts. Cutting to the chase, I wanted to know who are these “masked men” called Stakeholders stealing people’s identity and intellectual Property?

The answer is simple. It took some reading. The answer to moving IANA out of US territory and possession is NO, a thousand times no.

A few weeks ago, US Legislators held a hearing on moving IANA away from America. There were no answers as to Judicial oversite. There was no mention of 1Net.org. And when Congresswoman Zoe Lofgren wondered if Vincent Cerf knew about the push to move IANA by 2015. Not one witness at the hearing table said, ‘not only is Cerf on board, he is truly On board, one of the guys high up, way high up.’

Ask one or two witnesses at a hearing a logical question, too often, a 3rd party jumps in changing the topic abruptly or is at the witnesses shoulder within seconds, excusing their need to pull the witness “now.” One doesn’t think too hard seeing, yet again,  lobbyists or persons with Non Profit money to burn behind them. Experts Witnesses are placed by parties with vested interest.  This people are offered as having Expert Knowledge. Expert Knowledge is not a good thing to gift to  often professors in the Internet world especially are the little guy on the streets that will never get called as a witness if they aren’t famous or didn’t lose a child. Losing livelihoods and ability to pay bills, isn’t sexy enough a theme. Yet that is who is being ravaged by this Internet of Everything, owners of Copyrights, Intellectual Property and Identities, stolen, shared and Algorithmed across the Internet. A nice farmer in Wisconsin is being sold as a commodity in France. This comment in fact will be picked up and sold as a PDF, without license or permission, in countries like Germany and Japan, signators on the Berne Convention.

Watching a Hearing can be pain filled. Legislators, mostly, millennial staff, feed the legislators questions to ask. Quoted? New York Times, Washington Post? What ever happened to citing person’s in history or the little man on the street.

Legislators are expected to then rule on issues that change lives. A famous response in American legislative history is former Speaker of The House Nancy Pelosi saying, “you have to read it to find out what’s in it.” That Legislation continues to be written, still. The shift of the IANA out from under the Department of Commerce to the EU is beginning to feel a lot like that moment in American history. Sometimes Legislators just aren’t getting close to asking the right question. Sometimes they ask the right question, they just don’t know that are not being given the right answer.

Like who are the Multistakeholders and what weren’t Legislators being told before Legislators are pushed to vote, were two questions needing to be answered, moreso in the blush of State Department’s disruptive Tweets, and in light of State Department’s supporting entity’s like TOR.

The Answers the Legislators sought were available. Not in that hearing. They are on the 1Net.org website, a name not mentioned during the Hearing or in submitted testimony, like (i) what about security of IANA if moved out of America oversight, (ii) where would be the legal forum for American’s to resolve disputes within, and other questions able to be heard on the Library Of Congress Audio recording of the Hearing that day.

1Net.org clarified a question Legislators asked ICANN’s CEO testifying to convince the US Legislators to released oversight of ICANN from the US Department Of Commerce during the Hearing, “Hearing: Should the Department of Commerce Relinquish Direct Oversight Over ICANN?” chaired by Congressman Tom Marino. While 1Net.org will take reasonable and appropriate security measures to protect against unauthorized access, disclosure, alteration or destruction of personal information received, 1NET.ORG DISCLAIMS ANY AND ALL LIABILITY FOR UNAUTHORIZED ACCESS OR USE OR COMPROMISE OF YOUR PERSONAL INFORMATION. USERS ARE ADVISED THAT THEY SUBMIT SUCH PERSONAL INFORMATION AT THEIR OWN RISK.”

The Secretary of Commerce’s words were misleading. There is no security. There is no protection. There are no guarantees. What takes place on the Internet, as example shows, time and again, is not secure, wont ever be, as long as there is SPAM online, breaches, hacks and Facebook User Message Box’s being overwhelmed with Girls Selling, well, Girls.

What tips the Agenda of NETMundial are the words to enable “environment for innovation and creativity” the “ability to innovate and create hamust continue to allow permissionless innovation through an enabling Internet environment.”

Permissionless- as in Orphan Works, Collective Licensing, Decimating local ability to be self sustaining and maintaining local infrastructures for towns and by its people.?

1Net.org also states its “Standards must be consistent with human rights and allow development and innovation.” Isn’t a Human Right the ability to own their ARTS, protect their copyrights, and not have their identity stolen, Algorithmed or Human Trafficked.

The 1Net.org site states;                                                                                                                                         
“(4) … This transition should be conducted thoughtfully with a focus on maintaining the security and stability of the Internet, empowering the principle of equal participation among all stakeholder groups and striving towards a completed transition by September 2015.”       
(5) It is expected that the process of globalization of ICANN speeds up leading to a truly international and global organization serving the public interest with an independent status and clear accountability mechanisms that satisfy requirements from both internal stakeholders and the global community.

The active representation from all stakeholders in the ICANN structure from all regions is a key issue in the process of a successful globalization.”

The 1Net.org site continued, and this is where global Legislators must listen, “III. Issues dealing with specific Internet Governance topics of Security and stability” I read to say even they don’t have answers to Security and Stability; 

1(c ) While there is “room for new forums and initiatives…experience accumulated by several of them demonstrates that, in order to be effective, any cybersecurity initiative depends on cooperation among different stakeholders, and it cannot be achieved via a single organization or structure.”

(2) says at a time North Korea challenges South Korea, Israel is being threated by its neighbors and Russia just invaded Crimea, “Internet surveillance – Mass and arbitrary surveillance undermines trust in the Internet and trust in the Internet governance ecosystem. Surveillance of communications, their interception, and the collection of personal data, including mass surveillance, interception and collection should be conducted in accordance with states’ obligations under international human rights law. More dialogue is needed on this topic at the international level using forums like IGF and the Human Rights Council aiming to develop a common understanding on all the related aspects.

NETmundial admits there are “several contributions to NETmundial identified points that need further discussion and better understanding” the exact questions Congressmen Marino and Jeffries were seeking answers for during the April 10th Judiciary hearing, that “Different roles and responsibilities of stakeholders in the Internet governance ecosystem, including the meaning and application of equal footing                                                                                                 (i)Jurisdiction issues and how they relate to Internet governance                                                                  (ii) A principle based code of conduct and related indicators for the Internet governance ecosystem.

The 1Net.org “Way Forward” portion of their site says “It is expected that the NETmundial findings and outcomes will feed into other processes and forums, such as WSIS+10, IGF, and all Internet governance discussions held in different organizations and bodies at all levels.” Further, “All the organizations, forums and processes of the Internet governance ecosystem are encouraged to take into account the outcomes of NETmundial.”

Who are WSIS+10, IGF, 1Net.org? Stakeholders, too?

Confirmation of identities is needed before moving forwards. The stakeholders impacting Netmundial, must be named, along with the identities, of individuals not just organizations,  supported by the “High-Level Multistakeholder Committee”, composed of ministerial representatives of 12 countries (Argentina, Brazil, France, Ghana, Germany, India, Indonesia, South Africa, South Korea, Tunisia, Turkey and United States of America) plus 12 members of the multistakeholder international community.” Who are they? Global legislators are entitled to know exactly who “This Committee” is, name by name, photo by photo, including name by name, photo by photo of “representatives of the International Telecommunication Union (ITU)) and the Department of Economic and Social Affairs (DESA) of the United Nations, and representation of the European Commission.” A Legislator at the US Congress House Judiciary Committee asked this question, of the CEO of  the non-profit ICANN, when testifying before the Committee, predictive as the question was, ‘you are here today Fadi if we make this agreement with you. But tomorrow, when you are gone, if we offshore IANA out of America, what protections do we have when you are gone and the politics of “High-Level Multistakeholder Committee” change? Then what. What protections are in place?”

Protections start with Common Sense, which is not very common, it seems in the world of the Internet of Everything and Corporate and non-profit greed. Common sense says get a 100% handbook created provided to Legislators around the world, making this same decision of transferring global citizens lives Internet of Everything to Unknowns.

100% disclosure of photos, bios, background checks be provided to the international community along with their organizational handbooks, operational procedures or NO. Not gonna happen.

The same criteria applies to exposing photos, bios, background checks and identities of the “Executive Multistakeholder Committee.” The “Executive Multistakeholder Committee” is responsible for the “agenda of the meeting, its format, the call for participants and the management of the received content contributions, ensuring balanced participation of the global community.” There are “nine international members, including representatives of technical, civil and academic communities, the private sector and the Department of Economic and Social Affairs of the United Nations. The Organization of the event is completed by the “Logistics and Organizational Committee and the Council of Governmental Advisors.”

Name them- each and every person- provide photos, bios and background checks. Provide all content contribution submissions the Meeting received- 188 contributions from 46 different countries. This will allow global legislators to see first hand for themselves data they need to read and review, in order to make responsible decisions for their Constituents rather than relying on abbreviated pitches and summations they received from interested parties with agendas.

Respecting the “Multistakeholders” have on going meetings towards accomplishing their end goal, one would have thought, going slow with data release, would have been a no brainer.

It took time to locate this answer. This meeting is a meeting organized in partnership between CGI.br, the Brazilian Internet Steering Committee and /1Net. /1Net is described as “a forum that gathers international entities of the various stakeholders involved with Internet governance.”

Who is /1Net?

Their website states, “/1net provides an inclusive and open platform to discuss Internet governance matters for all those interested (individuals, governments, civil society, academia, technicians, and business. (http://1net.org)

The 1Net.org website says “For the last several years, the leadership of several recognized Internet organizations (ISOC, ICANN, IAB/IETF, IANA, the 5 Regional Internet Registries (RIRs), and W3C; sometimes referred to as the “Internet technical organizations”) have met periodically to promote better coordination between these groups.” /1Net’s website continues “While there have been brief statements issued… after the October 2013 meeting (known as the Montevideo Statement on the Future of Internet Cooperation) made some observations about the Internet which were fairly obvious but hadn’t been documented previously in a clear and consistent manner. High-level points from the Montevideo Statement include:
  • Importance of globally coherent Internet operations
  • Concern over Internet fragmentation at a national level
  • Strong concern over pervasive monitoring and surveillance
  • Ongoing need to address Internet Governance challenges
  • Need for evolution of global multi-stakeholder Internet cooperation
  • Need for globalization of ICANN and IANA functions
  • Need to allow all stakeholders (including governments) to participate equally
  • Need for the transition to IPv6 to remain a top priority globally”
The site says after the Montevideo Statement was released, there was “a call for a neutral, open forum to discuss Internet challenges.” Seven months before ICANN testified before the House Judiciary, the “1net initiative was created….is intended to be a neutral, focused initiative to discuss selected Internet issues with the intent of working towards actionable collaborative solutions.”

I have no recollection of 1Net being discussed with the Judiciary Committee. That said I don’t recall Montevideo Statement being discussed either. But its not up to my memory to rely on. There are the submitted testimonies. There are the witness prehearing disclosures that must be made. And then there is the video recording every hearing even when C-Span is not there. 

1Net’s site states their purpose is “to provide an inclusive and open venue supporting discussion of Internet governance matters for all those interested (individuals, governments, civil societies, technicians, etc.) 1Net wants to “deliver the results of those discussions to the agendas of established and developing Internet governance institutions.” 1Net’s site states “It is vital that the voices of all contributors be heard and carried forward to help shape the future of the Internet’s governance.”

I believe before this process goes further, this has to happen, name them- each and every person- provide photos, bios and background checks. 100% disclosure along with their organizational handbooks, operational procedures. This has got to happen. And should be easy enough in that “all 1net communications will be held electronically.” The Meeting were streamed online. Summaries of some meetings were prepared and “distributed electronically using our established electronic communication channels.”

Legislators must immediately join on to 1net’s mailing list. Identify the “author organizations of the Montevideo Statement on the Future of Internet Cooperation facilitate this discussion platform.” The 1Net site says “they recognize participation from a large and diverse set of voices is necessary to move Internet governance discussions forward.”

1Net should comply with Legislators request even before Congresswoman Zoe Lofgren gets on a plane to visit ICANN’s headquarters. The 1Net site says, “1Net.org will provide personal information to third parties, government authorities and agencies as and when required to:                                                                                                                   
(i) comply with applicable laws, regulations, legal process or enforceable governmental request;          
(ii) protect 1Net.org's or a third party's legal rights;                                                                    
(iii) receive contracted services or use of licensed products from third party providers;                         
(iv) comply with any court order or legal proceeding;                                                                     
(v) comply with 1Net.org's code of conduct principles;                                                                             
(vi) detect, prevent or otherwise address fraud or other criminal activity or errors, security or technical issues; or                                                                                                                                              
(vii) protect against imminent harm to the rights, property or safety of 1Net.org, our users or the public as required or permitted by law.”

Legislators need to know, in advance, the 1Net policy for “International Transfers.”

It says “By using our Site or giving 1Net.org personal information online, the User is directly transferring personal information and non-identifiable information to 1Net.org in the United States and may also be transferred and processed in other countries where our staff or service providers are located. The United States and such other countries may not have the same level of data protection as the User's jurisdiction.” Users living outside of America providing 1Net.org with personal information directly via the Site. 1Net site states, “The User is solely responsible for compliance with any data protection or privacy obligations in the User's jurisdiction when using the Site or provide 1Net.org with personal information.”

1Net’s “Information Security and Integrity” advisory says though 1Net.org “will use reasonable industry standard safeguards (which may include physical, procedural and technical measures) to protect against the unauthorized disclosure of personal information it collects and holds. 1Net.org will take reasonable steps to ensure that personal information collected is complete and relevant to its intended use” the User is subject to the Privacy Policies of those third parties websites which 1Net.org disavows responsibility for the 3rd party sites, owners and operators.

NETmundial is the Global Multistakeholder Meeting on the Future of Internet Governance. NETmundial was covered to address (i) Internet Governance Principles and (ii) Roadmap for the future evolution of the Internet Governance Ecosystem.

1Net.org’s Index covers these themes of “Open and distributed architecture, Enabling environment for innovation and creativity, Internet governance process principles addresses Multistakeholder, Open, participative, consensus driven governance, Transparent, Accountable, Inclusive and equitable, Distributed, Collaborative, Enabling meaningful participation, Accessibility and low barriers, Agility, Open standards. 1Net also says the “outline possible steps forward in the process of continuously improving the existing Internet governance framework ensuring the full involvement of all stakeholders… It must be inclusive, transparent and accountable, and its structures and operations must follow an approach that enables the participation of all stakeholders in order to address the interests of all those who benefit from the Internet.”

Except at the Hearing, no one defined who all the Stakeholders are. No one asked. Artists, writers and photographers around the world are entitled to know. We have little more left to be stolen online.  The Internet Governance Principles include Human Rights, Freedom of Expression, Freedom of Association, Privacy, Accessibility, Freedom of Information and access to Information, Development, Culture and linguistic diversity, Unified and unfragmented space… what about the ARTS Content creators rights… Identity Rights, Rights of Publicity and, it must be said, our Copyrights.

The word is not Piracy. Online or off, the word is Stealing.  And that's a Crime.

Stealing Intellectual Property is a global issue. To get protection of Content Owners moving forward the first thing that must be done is get the Signers of the Berne Convention on the same page.

No more Piracy  No more Infringement No more File Sharing  No more Hacking  Those are new words that have sex appeal when they trip off Legislators lips. Those words have NO connection to Laws on the books. Piracy, Infringement, File Sharing are Stealing. Hacking is Breaking & Entering. Trolling? Well, as lovely as it is to conjure images of story book Trolls, trolling is stealing too except in a world that has allowed itself to be tripped upside down, the real Trolls are the entity and people trying to take away an owner’s right to their IP, Intellectual Property, their Patent that has a period of time of exclusive ownership. Don’t like that? Well, then leave it and go create it yourself. But that is not the way of the world Technology has turned upside down. Don’t take it from me. Take this wisdom from the young man cited as saying even 99 cents was too much to pay.

That said, well is it? There is a punishment for the Crime. It is in the books of every country that is signed to the Berne Convention. There are price points at which crimes have levels of punishment- below $400 and above, greater than 50K or more. There are punishments on the books for crimes committed through the wires and by mail. Enforce these laws, theft will mitigate. Preserve don’t change historic laws in that the more things change the more they stay the same. Human nature is what it is- trusting and with some, deceitful to their core. Technology was established to capitalize on this reality.

If online stealing which feeds offline counterfeiting is to stop, there is one and only one tactic to take. Cut the head off the Hydra. Go after the private companies that built the Internet with all intent to exploit human nature, disrupting lives and models. For all of the talk at events I attend, hearings and matter I read online, it seems other than Technology profiting here, the others making the money are entities and people hosting more of these forums all the while the problem is getting worse and not better.

Legislators in America are sloooooowwwwwwwly coming to the reality I describe above. What to do? It is simple. Technology exists to stop online infringements. Technology exists to let Content owners know their site has been compromised. Technology innovators must implement the following recommendations and then? Technology (meaning the Founders, entities and individuals driving this scourge) to offline offshoring of profits must set up a fund into which monies will be channeled. Following the model established by President Obama following the BP oil spill where a  $20 Billion escrow account was set up [www.cnn.com/2010/US/06/16/obama.bp.escrow/‎ ], the same should be considered here with great great concern though too. As with BP, where money is Fraud follows, even with Ken Feinberg in charge, fraudsters come out of the woodwork, but this is a start.

Holding Tech Execs accountable for abuse of Fair Use and Safe Harbor will be interesting in that the very technologies they have created to stalk, chalk, algorithm, market, advertise plus is going to be their downfalls, in an Internet world where they acknowledge they store everything about us online, so too, it is to be expected that everything about them is online, too. If not, well, there is a law for that. It is called Tampering With Evidence.

As for me, I am putting in my invoice here and now for Identity Theft (bundled with Spokeo, 123people.com and Yatedo for Starters), my racing story used without permission by Freelibrary, my PDF’s printed and sold from Germany by YUMPU, my Hebrew calligraphy book being sold around the world even out of Japan at $400 a pop. I want a piece of that action. But what I want is to stand before the Peace Palace in the Hague and bring the suit that everyone should be in line behind me to bring- against all the Tech Titans- Google, Bing, Yahoo, AOL, plus each of who are facilitating trafficking of my name and my IP, globally amongst other Signators of the Berne Convention.

Why wasn’t a law on the books written, first requiring them to contact me and ask  me by email if I wanted to participate rather than after the fact? This here is my taking control of my profile. Paraphrasing Ronald Reagan….”Tear down that Virtual Wall.”

The next mandate I would wave my want to implement are the steps that will stop, well, mitigate the exponential exploding of IP Theft of all types.   1. Speedbumps against stealing  2. Lockdown pages 3. Require sites to provide Alerts and ISP captures.  And then I would require every legislator to disclose what tech company holdings they, and family members own and job affiliations too, to assure there has been arms length honesty on the issue of IP, ID and Commerce theft too.  Can this be done quickly? Well, speaking for America all we need is Mr. Obama to sign an Executive Order. Would be done in a flick of a pen, sort of funny, when you think of it in his Hi Tech world but also a testament to some things, like Traditions and Laws should be preserved.

The kid that thinks 99 cents is too much to pay will be hit with a reality check when he wants to buy things…ahhh the virtue of Crypto currency. Watermarks have gone the way of the dinosaur. People who steal content seem to relish in the Stolen Property having the Cachet of a Seal of Approval. Keeps the Content Cops at bay until someone connects the dots and realizes that use was without permission or license.

1.    Speedbumps against stealing are websites like Forbes magazine with pop ups that need to be clicked away. Forbes pop up at least provides a motivational phrase.

2.    Lockdown pages are the technology that seals a page so an image cannot be pulled off. Each and every friggin’ Search Engine “Images” page should be under order to have Lock Down pages in place within 24 hours.

3.    If Virus’ and Malware can be announced with Pop Ups when they are captured, then so too can the software be retooled to announce when Bots are stealing content. Tell you me why is it my Virus Detector lets me know if there is a Trojan nearby and not a Spider Bot. The answer is a no brainer, by design.

4.    All online entities capturing personal data that is bundled for sale must immediately be called on the carpet for what they are doing, albeit Techie style. They are involved in Human Trafficking. Call it what you will but a pig is a pig is a
pig and not an Elephant. The elements of Human Trafficking are met here. In fact, one chap from State, a year back looked at me pondering, when I said that, conceding I was right.  Don’t take it from me. What is Human Trafficking? Article 3, paragraph (a) of the
Protocol to Prevent, Suppress and Punish Trafficking in Persons defines Trafficking in Persons as the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs

 Stop the talks about Orphan Works, collective licensing and all that nonsense. What is happening is the little people are being hurt. Remember, all the big corporations started because One person had an idea. Orphan Works is no different than a fence removing ID from the stolen item. Tech developed bots to remove the Metadata. Collective licensing is socialism at its core, taking away a Property right each of our governments gave us. If all these ideas are so cool, then I challenge legislators to pick out items they own that are near and dear to them and give them away, after all you have owned them long enough, too. That is what IP theft is, after all, items we cherish. And don’t stop yet. Next, you will work next month. At the end of the month, you will hand your paycheck over to me. You have earned enough. Off point from IP theft. Totally on point because the right of a Content Creator is to create and profit from their Commerce. Governments micromanaging our property right is tantamount to IP Theft too.

If legislators had not become greedy and sought to please entities and people who failed to make complete disclosures then the “My Bad” is on Legislators for not have the noggin to ask the right questions at the get go.

Public education for IP Theft?  Enforcing Criminal Law.  They don’t have money you say to pay the fine. Everyone does. It may not be dollars and cents in the bank. Tell them if you take something that belongs to someone else without asking permission FIRST and in writing, then you are conceding to giving up something you own that you treasure.

The only appropriate regulatory measure is to bring back a culture of etiquette that says please and thank you and respects when someone says no. Listen, for all of the money spent on trying to raise public awareness, be it anywhere in the world including Singapore, the fact is, the Internet is so overloaded with things to click, the things that count are way down on the adsense count.

Take down notices are a waste of time. Do you really feel someone is threatened by a letter? All the thief does is take the letter then post it online in an attempt to embarrass the Rights Owner. Better yet, send a take down letter to a Search Engine, that letter will make an appearance on Chilling Effects as did my

I did tell the reps from WIPO at a USPTO event, “privacy” and “TOS” clicks should NEVER be at the bottom. No one reads to the bottom of a page. You know that. There should also, at the top of the page, be the WARNING in loud and Red stating the frauds that are known to have happened that just don’t get the airtime they need. If I had not asked the man about Frauds online in a Patent system, he never would have raced to bring out the Fraud examples he has been collecting- people that steal the Identity of the Patent system to which unsuspecting Patent owners send payments etc.

There is one more reality governments must cop to here and now- the trashing of investments made into Trademarks and Branding by the emergence of the competitive parallel product called “domains.” How do Governments justify to stakeholders that have spent hundreds, thousands, millions, even just a dollar developing a brand name, only to have the continuing rollout of domains. This system was deceptive at its get go for failing to disclose this newest product was under development, that people could buy and hoard names that belong to others- ie for example sake only  “Coca Cola” being squatted on  as cocacola.com  That never should have happened. The trademark owners should have been given a right of first refusal to buy and preserve their investment.

So, for starters, get Laws, Legislators and Enforcement on one page. Call File Sharing, Hacking, Infringement, what they are- S T E A L I N G- which is a crime. Now, with you all there, the playing field is level for something Global to be done.

I made a statement at the MIP Patent Forum held at the Willard Hotel in DC. I sat stunned at the complexity of the system the EU had designed to handle the Stakeholders wide expected Patent Issues that will arise. From local to regional to three seats of the higher courts, I asked one question. The answer, “good question, I hadn’t thought of that” was responsive to my question “with all the time and money that has been spent designing this system, what has been done to mitigate the exponential problems if the course this ship called IP Theft is not changed.”

Remember the answer as you move forward to do mimic the implementations of IP we are seeing rolled in to place around the world… they hadn’t thought of how to stop the problem. I have. Loop the lasso around the ankles of the Tech Giants, and…. Patience… wait….. YANK!!!! Will they all come tumbling down? If the recommendations I’ve made are considered into play, not at all. A stronger platform will have been made. Cities, towns, counties and countries will once again have their monies back with which to build infrastructure. Economies will re-balance. And common sense will rule the world, once again.

The groundwork of the New Economy is bringing global legislators together to lay a stronger foundation from which ARTS Creators Content, IP, ID and Enforcement will speak in a single voice to Protect profits and Commerce being made off their Content.

Ireland has long been a leader of culture exported around the world. Fair credit has not always been given. While American Exceptionalism is a frequent conversation on American shores, if you have worked both sides of the pond, as I had the honor of doing, one knows there is far more to be reminded of, much much more. There is a history and tradition extending back centuries that reaches in to today and towards the future.

Pre-internet, a woman could start a cottage industry from her kitchen table. Her children could be around her learning, the Art and Skill of their mum. That scene of women, instead of a job, chose Freedom to build a dream into an Empire, is challenged with the challenges of an online world- is being played out, in a home in Ireland, France, Switzerland, Dubai. Unemployment numbers are at crisis levels. Formerly employed, looking for work long enough, are tinkering with becoming entrepreneurs. Great ideas come cheap. The Economy will come together as women lead the way with what we know is right- online etiquette making it clear that Stealing is painless, from the White House to WIPO in Switzerland, to women in countries like Africa and Niger, stimulating their country’s economy with their fashion accessories crowd marketed over the Inter Making them into something that makes money has never been harder than before. 

While the oft description is Europe is the tail that wags America’s dog, if one has worked in England and Ireland Washington DC, they know of Ireland’s export to America should be written on the Walls of Justice. Maybe one day. Until then, there is an Irish imprint that graces the world that must be reminded, with Ireland’s signature on its doorstep. Irish Architect James Hoban’s, the architect of the White House.

Hoban’s inspiration was memorialized in a portrait by NC Wyeth; his legacy is celebrated in tributes by DC architects; a main street in a Georgian Revival subdivision in northwest Washington is named in his honor; the U.S. Maritime Commission launched a 10,500-ton troop ship named the James Hoban; the United States and Ireland mark the 150th anniversary of the architect’s death jointly issuing Hoban stamps to; the U.S. Mint celebrated the 200th anniversary of the White House striking a commemorative silver dollar with its obverse side featuring a portrait bust of Hoban set against the north entrance door.

Hoban, born in County Kildare, is an example of what Good Ideas come from the ARTS. Sometimes Good Ideas are simpler but equally as important in that importance should be defined in someone making a difference- in their life and in others- from the woman I remember selling fruits and sweet goods from a perambulators outside the walls of the Curragh. She had a good idea on how to manifest her being a solopreneur. Her idea went beyond dollars. Her idea came down to sense, common sense. She knew when she wheeled to work, smiled at racegoers the key to her sales was more was knowing, in a real way, your customer and smiling, the groundwork of Creating A New Economy. Something the online revolution, in its Algorithmic Bliss is forgetting. There is no New Economy without Old School Etiquette of Please and Thank You and asking before taking.

The innocence of the ARTS is being tampered with. Where before a woman could have one idea she could transform into something bigger, there is exponentially more infringement of movies and songs, than infringement of the written word- articles, books, artists renderings and photography. The new economy is hitting a stride that is building a backlash of Privacy being a forgotten word, Fair Use being the umbrella world to excuse taking someone’s Property Without Asking or Paying then hiding behind a Legal Wall called Safe Harbor. While it is fun to think of an idea based on someone else’s IP or ID, the cost to Society, and women everywhere, must be understood. I will explain with somewhat more detail, the cost….

Had he been born, two hundred years later, James Hoban would have been challenged with Intellectual invasiveness  of the Online World of Technology Infringement. Hoban’s ideas being sent back and forth online, being stored, hacked, filed shared and found in Search Engine image galleries, within seconds of his designs coming online. Hoban’s avatar would have been everywhere. Hoban’s fan clubs would have been wearing a stoic smile- his instead of their own. Most likely, Hoban’s Irish Eyes would not be smiling….

In 1764, Cesare, Marquis of Beccaria-Bonesana an unknown Italian jurist, philosopher and politician, wrote a single treatise the world still uses to guide criminal justice.

Long before Beccaria wrote his treatise, the Magna Carta was written. ing June 15, 1215, in a field at Runnymede, 40 rebellious barons demanded King John affix his seal to a document, the Magna Carta, also called The Great Charter of the Liberties of England, the Magna Carta Libertatum. Two principles expressed in Magna Carta resonate to this day, in America, like many other great ideas aka Content, America has ‘borrowed’ from the EU-  coinless parking metering, bikeshare, countless parodies of the Beatles, “The Office”, “Robin’s Nest” and countless other remakes of UK shows. Robin’s Nest? C’mon. Three’s Company starring the late John Ritter. “The Office”? Called “The Office”, not much of a stretch needed there. The two principles expressed in Magna Carta that inspired Americans fighting the American Revolution, are, "No freeman shall be taken, imprisoned, disseised, outlawed, banished, or in any way destroyed, nor will We proceed against or prosecute him, except by the lawful judgment of his peers or by the law of the land," and "To no one will We sell, to no one will We deny or delay, right or justice." These Rights are guaranteed in the Magna Carta in the Laws of the Revolutionists states, then into the US Constitution and the Bill of Rights.” The Fifth Amendment descends from the Magna Carta’s guarantee of proceedings according to the “law of the land.” The Fifth Amendment states, “no person shall . . . be deprived of life, liberty, or property, without due process of law."  [http://www.centerforcopyrightintegrity.com/magna-carta-the-grandmother-of-ip.html ]

Cesare Beccaria’s "On Crimes and Punishments" impacted the US Constitution, Bill of Rights and Judicial system in influencing the foundation of criminology which were built and expanded from Beccaria’s theories on arrest, prosecution and punishment.

In the treatise, Beccaria addressed preventing crime in his treatise "On Crimes and Punishments." Beccaria believed preventing crime was better than punishing criminals for their crimes. Beccaria’s Nine Principles a Society needs to effectively prevent crime are:

1) the laws must be clear and simple
2) the entire nation must be united in defense
3) the laws are against men, and women, not classes of men and women
4) the laws must be feared by the men and women in society, nothing less
5) the men and women, society, need to know for sure what the outcome of crime is IF they decide to risk breaking a law
6) the men and women need to know what the law in that knowing is part of the enlightenment of liberty
7) virtue has to be rewarded
8) the people need to be educated
9) the magistracy as a whole must observe and not corrupt the laws

How the hell could a Well Laid plan go so wrong in the IOE, the Internet of Everything age, where centuries old legal concepts are being torn apart by Legislators who don’t take time to educate the public of their ancestry that got them to here with rights that began in humble beginnings, actually, even earlier than Forty Barons and a King in a  muddy field off Runnymede. Seven hundred and ninety nine years, in the least, being tossed down the toilet because of something called the Internet of Things, that sounds great in forward looking SEC Filings but, in the real world of people trying to make a living doing what they love, isnt really turning out so great, is it.

Beccaria’s treatise concerned the criminal justice system. The criminal justice system is beginning to concern Legislators on Capitol Hill in America. One such Congressman, a Republican, is beginning to awaken to the IOT, Internet of Everything, being an IOEC, Internet of Every Crime- Intellectual Property Theft, Identity Theft, Human Trafficking, Money Laundering, the list goes on and on, AS does the list of goods the private companies have on every citizen of the world with an online presence. “They” know who you are, where you are, what you said to whom, when and, don’t be amazed, if one day the IOT shuts down with the global IOEC and disappear. In a way, Beccaria was a Snowden before his time. Because Beccaria feared political backlash, he anonymously wrote, his 1764 treatise "On Crimes and Punishments," so it was to the point and clearly understood, a lesson the EU Commission should take heed of in that the solicitation of this Public Consultation was NOT written in words understood by the Public the EU Commission seeks review from.  "On Crimes and Punishments," was reprinted in many languages around the globe, influencing creation and reform of penal systems.

Beccaria crafted his treatise like a three legged stool. All legs are needed so the stool doesn’t fall over. Points in this treatise include:

(1)               all individuals have freewill and make choices with freewill
(2)               all individuals rationally look out for their own personal satisfaction, which must be grasped to understand the relationship between laws and crime ie. see a cop on the beat? A criminal may decide to not commit the crime individuals rationally look out for their own interest which may include deviant acts and breaking the law, the goal being to stop deviant acts and laws being broken

(3)               People are predictable and controllable even when pursuing self interest

So the job of the Criminal Justice System, knowing people are predictable is to facilitate the Person’s rational thought in pursuing personal pleasure and facilitate their deciding that Deviant Acts and Breaking the Law is not a decision in their best interest. Global legislators role is to define the right threatening punishment, for each committable Internet Age crime, that will make Internet Users think twice  if they don’t want to do the “Time” or pay the “Dime.”

But people are people. And people take risks convincing themselves THEY are the one who wont get caught. In an Internet age, as Law Enforcement has never experienced before, unless Global Legislators get their proverbial acts together, catching a thief, nears becoming impossible in the Internet world of Aliases, Snapchats (disappearing conversations), Bitcoins (cryptocurrency that does not exist), Avatars (every one can “be” David Beckham or Posh by taking their ID, Identity photo and Right of Publicity that team owners and agents explain away citing it builds a Fan Base- tweet that, Kim Kardashian, or whoever on Team Kim K Brand, is paid to do a million things a normal human person could not accomplish in a month let alone an hour).

Team EU Commission must make the Punishment greater than the pleasure the person thinks they will get from doing the dastardly or committing the crime, ie in the IOT, Internet of Everything, 2D ARTS Creators IP, Intellectual Property, ID, Identity, Content and Commerce. Team EU Commission, Team Parliament, Team Congress and all Legislators signed on to the Berne Convention must get on the same page. There are no borders in the Internet of Everything. An online programmer in Belarus is being sought for gumming up a billion dollar healthcare system.

Tribute photos of Heroes fallen in current conflicts are discovered on dating websites. 

Due diligence is fallen to the wayside. Security, Crime and Punishment are the FIRST conversation the Review of the EU Copyright Rules should have addressed. Beccaria wrote, “"when the number of those who can understand the sacred code of laws and hold it in their hands increases, the frequency of crimes will be found to decrease, for undoubtedly ignorance and uncertainly of punishments add much to the eloquence of the passions" ( pg. 17)

The “Where to start” to address online Copyright Enforcement, Identity Theft, Human Trafficking, online Alias’, money-laundering is to revisit, the Berne Convention. With ALL the laws on the books with more laws being made daily because some Legislator somewhere thinks they have an even better idea than the idea that didn’t work before, the last thing the world of Intellectual Property needs is YET another new law. WHAT the world of Intellectual Property needs are the admission that laws really are One Cite Fits All- steal, it’s a crime! Pretend to be someone else, it’s a crime! Lie, to get money from people, it’s a crime. The menu of punishment may change but here is the example of a colleague of mine from London, who focused on getting Mounted Officers from around the UK on to the same “Command page” so, if and when, officers were imported to regions of the UK to assist with upcoming protests or the like, the officers all knew that, for example, “Red Fish” meant woman with red hair in fishnet stockings, and “Blue Fish” meant, well, wink, the man ogling her (with no hope. There is a little bit of Benny Hill in everyone even in a treatise such as this.) The need for uniform command across the UK was to get the job done, effectively. The EU Commission must get this Internet Oversight Job done correctly.

As for Alan Hiscox, the officer I refer to? I heard he retired. Lectured and taught around the world. If I had one man to bring on board for oversite here, I would hope he is still alive and make him an offer he cannot refuse…. Financially, I do mean, because what the EU put out in this review flies in the reality when Legislators know that “too many cooks spoil the broth.” Everyone has an opinion. The Legislative world needs fewer opinions, rather, more people holding global constituents in adherence to the Laws.

Adressing this matter region by region makes no sense when an image put online in Washington DC is within seconds grabbed by web bots then raped of its metadata being converted into an Orphan Work which Legislators, global, have bought in to the notion, these images have no mommies or daddies   [ http://www.centerforcopyrightintegrity.com/copyright-law-talks.html ]. They do. EVERY image in an Internet of Everything world has metadata. That is the way the Cameras and Image cards are crafted. The notion that a contemporary image is an Orphan Work, is frankly, the dumbest thing a legislator can believe. There is a bridge in the middle of Arizona for sale, too.

Adressing images of people found in vintage shops or at flea markets, well, they belong to someone too- ancestors, and the like, and should not be put up for sale without permission of the family. Without that permission, the only choices should be- next or DYI, do it yourself?

Museums are beginning to feel the pinch of items in their collections. IT belongs to someone, case in point the Denver and Seattle museums Super Bowl bet of artifacts. The  Canadian tribe whose Ancestry was on the line, shut that scrimmage down. The Nuxalk Nation denied their 135 year old relic being used in this demeaning bet. It is possible to teach the Etiquette of the Internet World, that just because someone has an idea does not mean it is a good one waiting to happen. Where to start addressing this issue? Not piece meal. Security First. And with the advice I gave a young lady who approached me while I was volunteering on a campaign, asking how would the Candidate handle a hate crime against a lesbian. You know. I didn’t know. BUT I knew the Candidate’s regard for Law and Injustice. The only answer was to state (a) I didn’t know and (b) knowing he was an investigative journalist too that he would stick to the law on the books that has worked well for centuries in that a Hate Crime is a Hate Crime whether you are
Pink, Blue, Plaid, Short, Tall, Gay, Straight, Muslim or Jew. He would look to that law as his standard. Otherwise with each parsing of the law, soon the only thing left is a mess of crumbs that make more confusion and no sense. She said, good answer.

Good answer? No, the only answer. TITLE XVII in America addresses Copyright Protection. TITLE XVIII in America addresses Criminal Code. Beccaria said KISS, keep it simple (stupid.) Steal. Crime. End of story. Otherwise Law Enforcement is spinning out of Control while online thieves are tearing down the Internet Highway.

Online crimes going on in the European Union and America are going on in the countries of all the signators of the Berne Convention. I learned along time ago, the more things change, the more they stay the same. There are two decker tour buses in DC, in NYC, in London, in Paris and I think even in Ireland, too.  Point being, in each of these countries, cities, and continents, there are laws on the books addressing Crime and Punishment and Law Enforcement oversite  ie. the USPS for mail fraud, the US Attornies office, RICO for wire fraud, and so on and so on. Use them, even tailor them. MOST important is to Authenticate the Regulations and Legislations that work or don’t work and don’t use Think Tanks. Or Lobbyists. Do what I did at UCLA PD, when I trained there actively building the first Crime Analysis lab of its kind on a college campus on the continent. Determine a sample population of time ie Three weeks in January, three weeks in March and three weeks in December, using those time frames to determine “piles”, data that will stack to show trends. Then use those trends to “quarterback” the next moves. The data will speak. Just like “algorithms” tell Mobile Marketers what you want for breakfast in three weeks. Ummm no. Beccaria said humans have free will.

Moving past Security which is at the core of moving the Internet forward without collapsing economies and cultures are specifics to questions asked on the Public Consultation on the review of the EU Copyright Rules.

STATEMENT OF FACT:
The world has changed.
The world moves fast. Criminals move faster.
Great forward thinking statements always have a seedy underbelly.
And there is a sucker born every day. The word “Facebook” sending shivers up anyone’s leg?
Legislators jumped on board the proposals of the Googles and the Facebooks so fast, ditching histories and archives of data, many wish they had back. Paperless society sounded great. Reality is it may be that as many trees are cut down today as were before the IOE, Internet of Everything. What is missing are documents. In the IOE, everything can be changed, even people’s histories. As is, a young lady at a hackathon opened my eyes. She was applying for a Foreign Service placement. She described that most people know her by her “Alias.” She explained, let me share, she was correct….

Google definition of ALIAS:
1. used to indicate that a named person is also known or more familiar under another specified name.
1. a false or assumed identity. - Computing- an alternative name or label that refers to a file, command, address, or other item, and can be used to locate or access it. -Telecommunications- each of a set of signal frequencies that, when sampled at a given uniform rate, would give the same set of sampled values, and thus might be incorrectly substituted for one another when reconstructing the original signal. Verb-  Physics Telecommunications verb: alias; 3rd person present: aliases; past tense: aliased; past participle: aliased; gerund or present participle: aliasing

There is absolutely no mention in this Rules review stating that identifying the problem for enforcement of Copyright Complaints that an online name is an ALIAS and an Avatar can be anyone or, as in the case of the Bitcoin “developer” Satoshi Nakamoto (中本哲史, Nakamoto Satoshi), the pseudonymous person or group that designed and created the Bitcoin protocol and reference software, that no one can say they know anyone who met Nakamoto

The Public Consultation on the review of the EU copyright Rules seeks to harm the good people, asking what can be done in a “perfect”, I think the overused word is “Harmonious” world.

When a politician wants to score a political home run, a connection is drawn to Irish roots, four leaf clovers are stuck in a lapel, a St Patrick Day parade is marched in, Green Beer is guzzled, the Potato Famine is invoked and Cops, Cabbage and Corn Beef are the Fail Safe answers in a ‘Name Ten Things Irish’ quiz along with Leprechaun, Four Leaf Clover, Shamrock and Pot O’ Gold.

Lost in the 24/7 of things used to be called News is the culture of Eire dating back Centuries, of Ireland being the home and history of horseracing, and Ireland the home of Technological Innovation preceding the Big Bark of America. People in America just don’t know much about Ireland’s “firsts” and ‘Things To Be Proud’ of.

Europe, Middle East and Africa.  Apple staffed its offices in Cork north of Blarney Road largely with foreigners able to provide service to counties of their native language, providing information ranging from tech support, to sales, to reseller support – the man from Spain speaks to customers in Spain, the woman in Norway speaks to people in Norway, and so on with Russia, Germany and the like- while Irish locals live below the poverty line on pay that is very low. There are tax advantages for Tech employers to pursue. Multinationals are  working abroad in America, too. Foreign Multinationals work in tourist areas that Americans are not quick to travel for work to. The Foreign Nationals say they come to America for ‘education,’ to learn to speak English. Some Foreign Nationals never go home remaining  in the shadows as illegals. Facebook CEO Mark Zuckerberg picked up the “Tech Industry Needs Immigrants” baton that Bill Gates dropped a few years back after politicking Congress.  Zuckerberg is pushing for Immigrant Access to America with his newly established Facebook PAC, political action committee.

Despite Ireland needing money for its citizens, Apple Ireland paid less than 1% tax to Dublin. Google cut its taxes by $3.1 billion over the last three years bouncing profits country to country, including Ireland, until Google profits end up in corporate tax haven, Bermuda. Apple’s cash and investments top $100 billion, outranking the Irish government’s annual outlay. Laundering money through Ireland is a slap in the Commerce Face. During the financial crisis of the past decade, Ireland needed to turn to the EU and IMF for bailouts. It seems the Apple’s Tech Venture seeding falls far Ireland where Apple planted Tax convenient roots. The Bank of Ireland and Limerick University announced a new €26m fund for early stage companies. The fund, managed by Kernel Capital, is comprised of €17m from Bank of Ireland, €8m from the government-backed Enterprise Ireland and €1m from the University of Limerick Foundation. That’s MILLIONS. Ireland has been the Flow Through Patsy for Technology BILLIONS.

The Search Engines and ISPs have been claiming FAIR USE and Safe Harbor as excuses for Unauthorized Use of Copyrights. Fair Use, Title XVII of the US Code, states clearly a Copyrighted Work may not be use din its entirety nor can its use impact the Copyright Owners ability to make a living from their IP. Safe Harbor is Search Engine and ISPs defense to Users of their Service utilizing images with the Search Engine and ISP claiming a “hands off” from liability for the User violating the Copyright. Not going to cut it when the matter is ultimately brought to suit. Complicity is a big deal more so when the crime is conducted through the mails and over the wires, let alone across the pond. Is there a kickback for the business being done? A question to ask and not the first time if proven. The fact is, Ireland cannot claim clean hands. Bloomberg News looked at the journeying of monies focusing on Google as the example to track Profit’s in a Double Irish scheme, transferring money from one division to another, writing off expenses in high tax countries and leaving profits for the tax haven. The example given addressed Google licensing its IP, intellectual property’s Offshore Rights. The Offshore Rights include the Search Engine, complicit in trafficking the 2D(dimensional) ARTS IP(intellectual) and ID(identity) of Users, profiting from the 2D ARTS IP and ID without compensating the IP owner for the use. Google’s offshore rights it licensed included Google’s advertising systems along with Android. These are all licensing to Google Ireland Holdings, an Ireland subsidiary of Google. It takes a small payment for the license to avoid the 25% corporate tax rate Google would be subject to in America. Google Ireland Holdings management is not in Ireland. Google Ireland Holdings are located in Bermuda facilitating Google Ireland Holdings dodging Irish taxes. Google Ireland Ltd is credited with 88% of Googles revenue overseas. Google pays $5.4 billion in royalties to Google Ireland holdings, monies due Users for their stolen IP, intellectual property. Google Ireland sends the royalty payments to Google Netherlands Holdings BV in Holland, a shell company without employees, that just receives the payments, which , had the money stayed in Ireland would have been taxable. The money doesn’t stay in the Netherlands. The money goes to Google Ireland Ltd. Which doesn’t keep the money. The money is sent on to the Bermuda shell company. By moving the $9.8 billion to Bermuda, almost $2 billion in taxes is avoided by GOOG, the trading symbol for Google Inc., in 2011, 8-% of Google’s pre tax profit.

The benefits of Cork, Ireland to Apple is obvious. The benefit of Apple to Cork is minimal possibly becoming a liability with cause for Legal Action for Copyright Violation Claims against the Technology entities growing. The looming lawsuit is not about Tax Dodging. The looming suit will be premised on IP, Intellectual property theft. Ireland is complicit to Technology’s abuse of Fair Use and Safe Harbor violations along the lines of Napster case precedent theft. Lord Justice Leveson’s Final Inquiry failed before it started. Levesons premise was MEDIA or PRESS exist.

Liverpool born Lord Justice Leveson was asked to lead the public inquiry into the culture, practices and ethics of the British Press, starting with News Of The World. The scope expanded to include the BBC and social media under the Inquiries Act of 2005, answering the question “ Who guards the guardians” providing “an essential check on all aspects of public life” the press writes on. Leveson held seminars including the topic “the law, the ethics if journalism both from broadsheet and tabloid perspectives and issues of regulation all in the context of supporting the integrity, freedom and independence of the press while ensuring the highest ethical and professional standards.” Leveson said he would hold “some discussion of what amounts to public good, to what extent the public interest should be taken into account and by whom” seeking recommendations for a “more effective policy and regulatory regime supporting the integrity and freedom of the press…” ” extent of unlawful or improper conduct with in among other media organizations…”.

Milly Dowling’s mother had said in a television moment or told media her daughter was ironing her jeans before heading by herself, a fourteen year old, to a concert down in London by herself. I believe Millie’s mother let her take the train, I believe, to Londong by herself. A parent let a child, a 14 year old child, travel in that way, at that late hour by herself. That detail disappeared from the news. I did look for it to repeat itself. As did Reverend Al Sharpton’s moment blaming the Jews for the Howard Beach incident disappear from being repeated in the news, so did this. Media? Politicos? Or Policing. Pick one. Or pick them all.

I thought that detail of Millie ironing her jeans to then travel to London was important. I cross credentialed as a CCIA, MPI, profiler plus. I was active in building the first discrete site crime analysis lab on a college campus on the continent. I was relevant enough to head to the Marleybone constabulary with that detail, bringing along my certification and my Chief’s letter to validate my input in this disappearance.

I presented my credentials. I stated my point. The constable I was speaking with stood up, came, stood next to me, put his arm on mine, looked me in the eyes and said, chillingly “There are some details better left alone.” And then he repeated himself. There was nothing further I wanted the constable, the British version of a desk sergeant to say. I understood a veiled threat when I heard one. I left. And I hoped I would never run into that officer again.I never forgot those words. I also never forgot Millie’s website set up in her memory nor the lesson parents need to hear that sometimes are children are children. And sometimes the world is the world.

Lord Justice Leveson did not adress the Soham murders. Was it two years before the trial of the teacher and her boyfriend that the Daily Express offered a reward for details leading to the capture of the murderers and finding the girls. I had sent my notes in to the Express. I spoke to the then editor. Headlines tend to dominate decision making for papers as headlines tend to dominate for constables with chilling tones. The Evening Herald in Dublin ran my pieces. From Day 1, I had described a John Steinbeck scenario of Lenny in the Grapes of Wrath. One girl spooked. Killed while being muffled. The other. A witness. We know the end of the story, don’t we. So who is more at fault, the constabulary who did not want to adress a 14 year olds train ride to London I believe Millie took, or the media, who wanted sales generated by wild goose chases of sightings by cab drivers, mounds in fields and so on. Or parents partying without oversight to children. David Beckham was made the hero here when in fact it was the little girl wearing Beckham’s number which contributed to their deaths. Beckham’s 7 was the conversation opener between the murderer and the murdered.

Lord Justice Leveson focused on the young Millie Dowling but I did not hear mention of the security breach of the Buckingham Palace when two men calling themselves journalists bragged of having gone into the room that, I believe, Condaleeza Rice was to have slept in when visiting the Palace. That Lord Justice Leveson ignored the risk to security of our Queen is a fine example Lord Justice Leveson may have set out on his inquiry with an agenda or an answer in mind.

The reality is Media and Police need each other to survive. Through my efforts, and at personal cost, I was instrumental in fostering dialogue between the White House News Photographers Association and MPDC. This is not yo’ momma’s police as the urban expression is tweaked. Officers today have been raised in Social Networking. Citizens carry camera gear as sophisticated, and at times more sophisticated, that credentialed media out on jobs. Along with homemade press credentials technology allows to be looking better than real, the risk from terrorism, nutters is greater than ever before. Officers may stand down on issues due to concern of being sued for doing their jobs,  ie partners who call the police then turn on the police when their lover is being arrested, or in this case, media photos being used or abused in issues involving police. Bottom line fact here, Lord Justice Leveson lost the opportunity to require Officers to meet with media to (a) understand how news gear can be used for terroristic purposes ie. Digital cameras when snapped without a card inside will show a photo leaving the cavity open for carrying (b) foster positive relations between Media and officers who may and do need each other in moments of concern ie. Identifying persons purporting to be media causing possible risk. Lord Justice Leveson must realize ethical officers and ethical media persons want to go home at the end of the day to their loved ones. Lord Justice Levesons direction should have been to build a simple, bullet pointed national common language handbook for media and officers to follow, similar to the National language handbook established by former Mounted Alan Hiscox recognizing that officers brought from across the UK where and when needed all had different signals which created chaos when brought to work together in the same event ie marches in London near Parliament. 

This Inquiry was a teaching lesson and building point lost.

Who is to say the investigative work of the police was more valuable or less valuable than the investigative work done by the paper. It was what I read in the papers that allowed me to profile both murders, building piles of data and sorting through the piles for details. Millie’s case and the Soham’s girls situations are prime examples of bad policing where as Lord Justice Leveson words ring biased. Where police failed, Media mattered.

But Media died. Press is what one does to a doorbell. Levesons limited understanding of what ‘media’ is in an Internet age doomed his chairing the inquiry before it started http://www.levesoninquiry.org.uk These days too many badges saying ‘press’ are home made at the local FEDX/Kinkos by wannabes wanting in on the Circus, people with opinions they express on the internet seeking their fifteen minutes of fame. Media, as it was once known, officially died in DC in the East Room of the White House the day President Obama signed the Health Care Act in to law. Media’s money shot was blocked by audience holding cell phones and cameras high in the air credentialed photographers could not shoot around. The President was using his bloated photographic staff to provide then distribute ‘behind the scenes’ photos over Flickr, Shutterfly, Instagram, Pinterest, youtube plus.

After several months of deliberating Media Gone Wild, Leveson provided a 2000 page report on his inquiry. Only ONE of out of over 2000 pages addressed Social Media, in a world gone lawless with the Internet outpacing legislators attempts to regulate online with measures to end lawless practices. Leveson erred when he wrote “the press on the other hand does claim to operate by and adhere to an ethical code of conduct” and “the Internet does not claim to operate by express ethical standards so. Bloggers and others may if they choose act with impunity.” Leveson failed to note Internet users and Print are equally bound by local and other laws- business, racist, hate speech, threats, fraud, and so on. The difference is, Bloggers and others cannot be found easily, if at all, while Print can.

Leveson failed to note everyone today is Media from the 5 year old girl taking video at a red carpet for Michael Moore’s movie, about big money in politics, to the stalking grandmother who spends her retired days going from one Think Tank event to another, camera in hand. Had I not been there to separate Dick Thornburgh from her, one can only imagine. The fear in his face. The lack of think tank security with on site staff not trained how to separate the former US Attorney General from a woman he did not want to offend lest that become a moment she posted to the Internet, picked up in the broken telephone then reported as ‘by media’ who are unfettered, untrained home grown “gotcha” people misrepresenting themselves as “MEDIA”. The Leveson Inquiry did not address them. Understandable, Leveson does not know Media died. Entertainment lives in print, online and on television.

The Internet is bloated with brain farts called Twitter, glutted with the obscenity of Reality TV starz with handheld PDAs, people with cameras turned stalkerazzi, feeding images to online Internet sites offering Photos of Stars to whoever will pay for pics of Famous people. These sites pop up overnight at little cost, tracking stars or politicos with GPS, interrupting stars in bathroom stalls, chase them into parking garages or in family moments. Actor Joey Pantalone complained he cant take his family to dinner in a public restaurant without being interrupted or followed or snapped with a spoon in his mouth. Andrew Dice Clay and Shia Le Beouf threw coffee at a paparazzi stalking them. Hayden Pantierre said she didn’t know how to ask the paparazzi stalking her to go away, fearing the paparazzi would sell a story on her not being nice.

Leveson said press “operates very differently from blogs on the Internet and other social media such as Twitter.” Leveson was correct. Land locked print entities are trackable at brick addresses while the Internet runs lawless with anonymous postings, untrackable site owners, no brick addresses, no phone numbers, no way to track entities invading privacies, participating in ID theft, IP theft. The Internet allows phantoms to disappear in a click of a DELETE button.

Lord Justice Leveson erred saying there is no longer a presumption of privacy. There is a presumption of privacy. There is a failure to define privacy boundaries from invasion by technology giants Google, Microsoft, Bing, and the consumer. It isn’t phone hacking that should be on trial. The individuals privacy is under attack by marketers bundled user data for targeted marketing. TV technology is being used to watch viewers for targeted marketing. A couple snuggling on their sofa will be sent lovey-dovey advertisements between shows.

Lord Justice Leveson saying Print Media has a grasp on Reader Consumption was wrong. New York State’s oldest newspaper the 214 year old Ballston Journal was closed down December 21st, with owner Angela McFarland citing “increasing production costs, shifts in readership and declining advertising revenue all played a part in her decision to convert to a digital-only format.” McFarland was transitioning the Journal from print to online. Costs for ink, paper and mailing were continuing to rise. McFarland was seeing businesses “relying on social media hoping that will get them through.” McFarland wasn’t seeing a lot of local advertising dollars being spent. Local officials, chambers of commerce and investors did not provide the $25-$50K she sought. McFarland said “online and social media traffic began to outpace print subscriptions… I think a smart media person learns to go adapt and go where the eyeballs are.” McFarland hired a consulting firm specializing in digital news to help her transition from print to paywall. Paywall means some content is only for people who pay for access to the content.

Billionaire investor Warren Buffett owned World Media Enterprises closed the 143 year old Manassas News & Messenger and its website InsideNoVa.com covering news in Prince William County, Manassas and Manassas Park Sunday. All employees lost their jobs. Seventy two other jobs have been cut in the company. World Media Enterprises purchased the paper, as well as others, from Media General in June said the paper was losing money and “had a tough time finding the sense of community that a community newspaper needs to prosper.”

The Newspaper Association of America stats indicated the nine months prior to September 30th, “print advertising in the nation’s newspapers fell 7.7% while online ads grew by 2.5%.” Online ads are 15% of advertisers $16 billion spent towards reaching newspaper audiences. Digital revenue has a ways to go to make up for lost print sales. Fenimore Asset Management media research analyst Drew Wilson said newspapers appear to be losing out the most “in the reapportioning of the print pie.” Wilson predicts the way forward is more digital only publications and “definitely” less print publications. Publications continue to cut back print editions. Not even selling Newsweek for $1 could save America’s iconic publication. RIP December 31st, Newsweeks last print edition.

The Pew Research Center for the People & the Press, a project undertaken in conjunction with the Project for Excellence in Journalism’s News Coverage Index, conducts an ongoing content analysis of the news. 1000 adults over the age of 18 are interviewed by telephone.

The Pew Center study corrected Lord Justice Leveson’s misstatement. Leveson said, television continues to be cited most frequently as a main source for national and international news, at 70%.” “For young people, however, the internet now rivals television as a main source of national and international news. Nearly six-in-ten Americans younger than 30 (59%) say they get most of their national and international news online; an identical percentage cites television.”

A second Pew report showed news is going mobile seeking mobile platforms to stimulate revenue in local markets. 28% said losing their local paper would hurt their ability to keep up with information. 39% said the “loss of the newspaper would have no impact.” “Nearly half of all American adults (47%) report that they get at least some local news and information on their cellphone or tablet computer.

Leveson was wrong stating (1) “although the press is not a person or a body corporate or incorporate, I shall adress notices under rule 13 of the 2006 rules to ‘the press’ as a class likely to be restricted to the national (as opposed to the regional) press but to encompass not only core participants but also other companies who operate titles that fall within this definition.” The media is made the wrong up. Leveson do.

Further more noting ‘most people will not assume that what they read on the Internet is trustworthy or that is carries any particular assurance or accuracy.’ Suggesting there is a ‘qualitative difference’ between seeing a picture posted online versus people seeing a photo on the front page of a newspaper is ignoring most people read news online. It is Online communication not a dying print industry that spreads words, truth or lie (twitter at less than 144 characters) faster than wildfire. This is a world where each countries search engines censor what the rest of the world sees. Malfeasance in the UK may not be seen by the rest of the world. Malfeasance spread to the rest of the world is blocked from the UK- a decision made by legislators and the megaliths Lord Justice Leveson chose not to address.

As a faith filled man, Lord Justice Leveson understands the comparison of the Internet’s scope of distribution being beyond imagination with the facility to spread embarrassment, shame and lies within the Internet vortex best likened to Sodom and Gemorah, a thousand voices speaking at once lightening fast rather than the slow speed of print- one purchased newspaper at a time.

Leveson forgot.

Media, print, online are descriptive words. People are what provide content. Leveson’s one and only conclusion should have been involved persons are the sacrificial lambs used for example just like the olden days of England where Justice took place in public squares in view of the masses. Times haven’t changed. Innovation has. The new public square is the Internet not print. People failed. Humanity disappointed. Not the print industry but people who think the internet is a forum to get away with breaches of decency and etiquette.

Lord Justice Leveson failed to acknowledge in his ONE sheet addressing Social Media that content providers to websites, blogs, have access to places real media cant go. Leveson failed to acknowledge Print Media now repeats its content online. Real media movement at events is restricted by their Press handlers who restrict access. That is exactly how Mitt Romneys campaign killing youtube moment was made. Media was not allowed in the room. Someone with an agenda and a Guest Ticket was in the room. This was the case with naked Prince Harry. Media didn’t take the photo. An attendee with a PDA knowing the value of the photo took the picture. I photographed the Prince at Cirencester polo. Credentialed media were told by the Duke not to photograph the boys departing in Wills car. Media respected the Duke. We turned our camera lens down.

Lord Justice Leveson holding what is left of the Print Industry to a higher standard is wrong. Leveson should have held society to the same standard, one of the Ten Commandments as an orthodox Jew he upholds, “RESPECT”. The words “Kabed et aveecha v’et amehcha”, “Honor thy Father and Mother” apply to how we treat our fellow man.

Lord Justice Leveson holding what is left of the Print Industry to a higher standard than online mega-entities “likely to have to operate under considerable new constraints but big online publishers such as Google, Facebook and Twitter are likely to remain unaffected” confirmed Leveson’s unsuitability to chair the Inquiry. Governments including the UK government are using technological giants to implement increasing invasion of privacies people once held even in their own homes. Twitter, Facebook, Google etc turn in private conversations to law enforcement. People are learning in real time, real life, litigation and in Technology industry disclosures that their online communication did not DELETE when the User clicked the DELETE button. It is those exact megalith “online publishers such as Google, Facebook and Twitter” who hold our lives, trade secrets, legal briefs, indiscretions that Lord Justice Leveson should have addressed not what is left of a once glorious profession- Print, moreso since the megaliths admit they are not exempt from hacking. Even Lord Justice Leveson and his family are at risk for public humiliation if groups like Anonymous or Julian Assange decide to expose what goes on beneath a Lords robes.

Technology is mirroring peoples real time behaviours brought to the surface by the Internet giants. Courtesy of the internet, online stalking is the new way- using GPS tracking and Foursquare, disclosure of private information- banking details, addresses, unpublished numbers even private passwords to websites, advents like google maps showing a person at their home in great detail, poking, copyright and patent theft, IP and ID theft. Lord Justice Leveson missed his chance to create the higher standard to rein in the global Internet as continues as it continues to morph.
