Hearing room seats would be filled, if and when, some of Hollywood's Uber stars would be invited to adress the value of a Patent to them... did they know all the paper meant was the Right To Sue and IF, knowing that now along with knowing how the Internet has changed the world of Intellectual Property and business, would they go to the expense of Trademarking, Copyrighting or Patenting or do they feel the money is better spent elsewhere since the Legal Protections are failing investors in to IP....

Congresman Bob Goodlatte, at a Judiciary Hearing, asked the witness seated before him if there is a difference between Art, Music and IT when it comes to Copyright. Well, the answer, is yes. The answer applies to every situation that touches man, be it at home or work, living space, workspace or just being. Man is never alone. Alone, he is with his thoughts. In the outside world, Man, today is inundated being trained not to be alone, being designed to be pushed together. And ideas that have survived the centuries are being usurped by people who fail to attribute, their idea isn’t a new idea, just an old one reworked or, as the millenials describe it- repurposed.

Entrepreneurs, the new wave for souls leaping in to independent commerce generating, are using coaches to help them uncover their blind spots and move business goalposts. Once upon a millennial, pricey coaches were called mentors. Mentors used to be moms  and dads, aunts or uncles, or grandparents imparting wisdom they gleaned long before New was new, with a perspective from when life was simpler. Family taught. Technology has in many ways fractured family. It has taken away real Touch, replacing it with Virtuality.

Corporate coaches are sounding boards, even day to day cheerleaders there for someone who needs another’s support to get from here to go. Some say corporate coaches have a high skill ability to look across a wide variety of situations they may have seen play out from different angles, in different environments in different ways. Corporate coaches can even be called Help-A-Holics who group masterminds in to being their own master. People are told by the Corporate Coaches that in order to be leaders they need to let go of what does not work, to be Nimble and Shift, pivot, with their  mantra being ‘the bad day I had is going to be better tomorrow.’

A responsible corporate coach will tell their client, Be Prepared To Fail. Failure is part of moving forward.

Failure, part of life, is recoverable from when one has loyal loved ones around them. Otherwise, life is a shoestring the person hopes is a lifeline. Corporate coaches have shared clients express the client need an outlet, a cheerleader, someone they can explain things to who will tell them it is going to be ok. This need may be just why Marissa Mayer of Yahoo brought her telecommuting flock back in to the corporate nest. People are people. Dogs are dogs. People and dogs thrive in packs driven by scent, sound and sentiment.

For a company to survive, the company needs to know both the corporate and their own personal relevance. In a fast moving world that does not understand that it takes time to percolate a good, solid, “sustainable” idea, just like friendships. The Virtual definition of Friend is “by click.” Old schoolers know true friendship is defined not by Foursquare or having a “great” idea that is developed fast without business models. Millenials are told Business models are gone the way of the dinosaur. Gone. Not needed. That has always been true. A good business model is defined through experience of what has or hasn’t worked. Like dictionarys.

A misuse, misspelling of a word or parody of a developed brand, now create the new lexicon. Words like Desk licensing, repurposed, demo-ed, rent days, grid view, listed view, and seat by suite are terms used by million dollar seeded startups tearing the real estate market apart. Start up firms are selling every available space that is imaginable using programs built to sell and select seats on airplanes to people who don’t have the patience, consumers once had when entering negotiations. The new wave marketers goal is Speed to Occupancy, getting more exposure for a company’s assets.

Wework began, loosely, as an entity driven to pay for space they could not afford. The founders of Wework saw this as something their peers may want too- cheap space without commitment- terms that define the economy today. House buyers are transitioned to renters. Renters are preferring thirty day notice to leases. Leases can be signed for by-the-hour for everything. Key is identifying if there is a need.

A Bisnow panel of guests talked about the creative future of real estate. Sure, everyone contributes comments to moderator led questions. Ask the same panel one-on-one questions afterwards, peceptions change. Glowing insights into Google labelling chair bottoms with what exactly someone is sitting on is kitschy cute but really...... looking at design layouts for work suites that look like glorified fishbowls with fashion schemes that cost a fortune to keep current with design trends are all horrifying mindbogglers beggaring one to ask industry how long it believes it can continue to dance on the head of a pin before it goes the way of the original hive, the bees. The beehive community is collapsing. Valentine sales begin before Christmas is over. Mothers Day daffodils are popping up in stores before Easter has even begun, the point being, in being desperate to cover bottom lines, loyalty and investment are tossed from the moving train heading to the cliff with diminishing time to break.

The high price of renting door knobs to strangers is being learned by AIRbNb. A landlord came home to find his apartment filled with fatties engaged in an orgy. The landlord believed he rented the space to a family in town for a wedding. People are climbing in to cars with unlicensed drivers who have not undergone background checks. A flight that disappeared over the Indian Ocean had passengers on board using falsified passports. All this and the lesson parents still tell kids is don’t talk to strangers. The world of Technology is a world of strangers.

Online is just that. Who is that person you allowed entry in to your life, bank accounts plus. Who is that un-eyeballed person sitting in a cubicle next to your daughter or wife? How big of a gambler are you>

Humans are said to be the factor driving people paid to think. Architects design for spaces they don’t walk at different hours to understand the analytics they accept as gospel from trends and reports and studies entities conduct from questionable population numbers. The stats aren’t dependable just printed and shared online which in this day and time now is taken to be gospel. Old school are told to adapt to the millennial way of party hardy embracing flexibility and choice. Not.


The price of Instant Information is Life has become a prototype. The mantra “What Technology wants” is driving common sense away.

Here are the walk away points the drivers of Open Market should be buttonholed to embrace

(1)    Human engagement does not pay to run a city, a town, a state or to maintain their infrastructures

(2)    Forcing synergy is daft. Remember, one can lead a horse to water but you cannot make it drink

(3)    Technology disrupts human behavior. Technology does not disrupt human nature

(4)    The price of the ME (as in me, myself and I) culture is lack of loyalty which cannot sustain investment

There is no future for industry if the accepted norm is to encourage people as an island on to one’s self. Barbra Streisand sang it,
“People who need people are the luckiest people in the world.” Babs wasn’t talking being used to collect cookies from, or to help formulate Algorithms marketing data then targets demographics with, or youtube videos from which people no longer have to wait for their 15 minute of fame. Then can DIY, do it themselves. And that in a nutshell, is what being Human is all about loss of security, fear of failing and fear of trying in a world set on disruption… Loss of personal safety nets, family in an unfamiliar world of everywhere all at once

Everyone knows the Food 5 SECOND RULE, you know, when the food hits the floor the dog, the kids, the plumber and barefoot Nicole From Next Door just walked over. Pick it up before 5 seconds, you are good to eat it without nary a thought.

Google is rolling out its CRAZY S*%$T I WISHED I HADN'T DONE experiments, Gmail Users can opt in or out of, including a version of antiquated AOL's UNSEND THAT EMAIL feature. Google's UNSEND is up for testing Do Overs of things Users wish they didnt hit SEND on.

Simple is as simple does... WITHIN THREE SECONDS, click the SETTINGS cog wheel upper right of the open page, go down to the SETTINGS tab (bottom of the Drop Down, found in the same rectangle as Themes and Help), click SETTINGS. The SETTINGS page opens up. Three Tabs in from the right- (right to left) THEMES, OFFLINE is LABS. Click the LABS tab. Page opens up to GMAIL LABS: SOME CRAZY EXPERIMENTAL STUFF.  Remember the 3 SECONDS to unsend THAT email, so peruse later at fun things to do within GMAIL. Three up from the bottom, currently, is UNSEND.

Dear President Obama,

We the undersigned children’s book authors and illustrators write to express our concern for our readers, their parents and teachers. We are alarmed at the negative impact of excessive school testing mandates, including your Administration’s own initiatives, on children’s love of reading and literature. Recent policy changes by your Administration have not lowered the stakes. On the contrary, requirements to evaluate teachers based on student test scores impose more standardized exams and crowd out exploration.

 We call on you to support authentic performance assessments, not simply computerized versions of multiple-choice exams. We also urge you to reverse the narrowing of curriculum that has resulted from a fixation on high-stakes testing.

Our public school students spend far too much time preparing for reading tests and too little time curling up with books that fire their imaginations. As Michael Morpurgo, author of the Tony Award Winner War Horse, put it, “It's not about testing and reading schemes, but about loving stories and passing on that passion to our children.”

Teachers, parents and students agree with British author Philip Pullman who said, “We are creating a generation that hates reading and feels nothing but hostility for literature.” Students spend time on test practice instead of perusing books. Too many schools devote their library budgets to test-prep materials, depriving students of access to real literature. Without this access, children also lack exposure to our country’s rich cultural range.

This year has seen a growing national wave of protest against testing overuse and abuse. As the authors and illustrators of books for children, we feel a special responsibility to advocate for change. We offer our full support for a national campaign to change the way we assess learning so that schools nurture creativity, exploration, and a love of literature from the first day of school through high school graduation.

In College Park Maryland is stored a memory that haunts America forever.

Original footage of President Kennedy’s head fracturing into countless beads of brain and red sits, cold storaged in a National Archives vault, constant at 25 degrees and 20 percent relative humidity. The cameraman wont win an Oscar or Emmy anytime soon. Nor did he want to. He wanted the memory that haunted him to go away. It wouldn’t. Abraham Zapruder had been in the right place at the wrong time, at the corner of Dealey Plaza and Elm with his Bell & Howell Zoomatic in hand, pacing his film use before the motorcade arrived. Street. Zapruder, a Russian immigrant, was expert on confusion if the young president was dead or injured. Faster than teletypes could transmit, Zapruder let people know. Without question, No, John F Kennedy was not injured. Kennedy was dead. Zapruder reportedly told people he saw JFK’s head come off. Zapruder had the film. Zapruder was a wanted man. Word got out Zapruder had film. Media tracked him down. Zapruder isnt like Smith. Uncommon names are easy to find in phone books.

Offers came in within hours and never stopped. There is a high price willing to be paid for access to Intellectual Property as is the film Zapruder shot decades ago.

Frame 313. Blood. Brain matter. A geyser freed up into the air. Six feet of film. Zapruder owned it. Makes one wonder why the world begrudges the King family’s claim to MLK’s speech. Penned words. Video. It is all Title XVII territory. Title XVII? The Copyright Code giving ARTS ownership and control to Content Creators.

The film outlived Zapruder who died of cancer in the 1970’s. A wire service offered $100,000 for the footage. Another offered $200 a frame. There is no price to erase Survivors Guilt. Zapruder told people he was ashamed of what he did, capturing the collapse of America’s Camelot.

Speculation is that Zapruder took $150,000 from Life Magazine for the  film, rights, the whole enchilada. Maybe. Zapruder, a Russian immigrant was private about such details. There was benevolence too in the deal. Oswald had a second victim forgotten in the annual much made of a beloved president cut down in the youth of his presidency. Zapruder gave Dallas police officer JD Tippit’s widow $25,000, at least that is what Zapruder admitted to the Warren Commission investigating conspiracy theories. Copies of the film were leaked. Bootlegged was the term back then. Piracy is the term these days in addressing copyright unauthorized use.

Time Inc had custody of the film. Time owned Life, interesting play on words. Time got tired of Life and custoday of America’s iconic death film. One dollar. That was the price Zapruder’s paid to get back footage that ate Zapruder away until he died. The vision of brain spurt stains one’s soul.

When the Federal Government created the Kennedy Assassination Records Review Board in 1992,   the Board said Zapruder’s film was public property. April 24 1997 negotiations began with Zapruder’s kids and wife. Task at hand was putting a value to Death eternally in film. Baseline was in motion. The Zapruder’s had been licensing the film since 1976. Monies earned?  $878,000 in fees. Value? Justice Departments offer was not accepted. $750,000 and Zapruder’s family could keep the Copyright. Zapruder’s families comeback price was eye opening. $18.5 million for the film. Keep the copyright. Two years later, Zapruder’s heirs took $16 million, kept the Copyright which they donated to the Sixth Floor Museum. The cash they kept. The Abitration Panels decision was  made July 16 1999. The offer was not conveyed to the Zapruder’s for days.

July 16 1999. A small plane went down. A young man and his wife died. John John and his wife Carolyn Bessette. John John? You know him. The world never forgets the brown haired little boy in a blue coat, shorts, black shoes, saluting a riderless horse and a carriage pulled coffin. The same boy featured in an Oval Office photo climbing out from a panel door in his dad’s desk.

His dad? President Kennedy. The boy. John Kennedy. Both? Forever young preserved in Copyright with a steep price for all parties involved….. six feet of film that stains America still. Why? Z313 existed long before the social networking digital age robbing everyone of privacy. It fed and answered to humans need of voyeurism as much as people deny. Zapruder died with survivors guilt. He found no pride in archiving murder.

Zapruder's family may have received millions. But the price Abraham Zapruder paid for being in the right place at the wrong time, shooting film that outlives lifetimes, Frames 225 to 313, Six feet?

Haunted, for the rest of his life.

Edith Lee-Payne and Rowland Scherman have a thing going on for over 50 years. It was more than an accidental meeting. It was kismet.

Scherman was a newbie snapper, everywhere taking photos for the US Information Agency, an entity that didn’t survive for years as his photo did. Did he have an inkling his photo would resonate for decades? Never. He thought those photos would last. Nope. The kid did. She grew up to take part in the March again, fifty years later.

Edith had traveled from Detroit to DC to take part in Dr Martin King’s historic March. The year was 1963. Edith and her mom had heard Dr. King speak in Michigan. The women felt Dr. King was speaking to them to join with him in the South so they climbed aboard a bus. Payne recalls, even as a kid she was excited.

Scherman went on in his career to to shoot for Life Magazine, National Geographic, Match, Playboy and others. He took photos of celebs- the Kennedys, John Lennon, the Beatles and Dylan. Scherman won a Grammy for his photo of Bob. Three hundred thousand people that day, and Edith now lives forever in history, the face of the March on Washington in 1963. Edith’s name gets spelled right. Scherman’s? Rarely.

During the March of 2013, Edith is a superstar. Over 23 interviews with reporters from France, German and other countries around the world, the 8 year old from yesterday, lived that moment over and over. Edith doesn’t tire. Her photo has even made the Wall of Fame over at DC’s icon, Ben’s Chili Bowl, the only DC entity not burned down during the riots of the ‘60s.

Every so often Edith and Scherman do a road show together. The BBC made that request, brought them to DC. A man walked by. Edith chilled. It was Scherman. Their connection is forever. Edith said it is God’s favor on her, this day in 2013. Edith’s mom was with her, in spirit. The woman who worked as a domestic raised an icon. Sometimes dreams are bitter sweet. Dr. King had a Dream. And he shared it with Edith. And Scherman shared it with the world…..

The USPTO hosted its 2nd anniversary just about to implement session at its Alexandria campus to both an online audience and in house in the Madison Auditorium. Online attendees missed the color of being at the USPTO, the inventors museum on the main floor and Inventors Of Tomorrow exhibit on the café floor. YMCA Summer Camp attendees submissions, for different age categories, were on display, in wait for a 6:00 reception for the campers and family. If one had any question of the future of a Green America, the campers robots, pig and other creations most perceive of as trash, was pretty spectacular to peruse.

The America Invents Act implementation rolled out a years after being passed, with little surprise as to Government programs- a lot of papers, $10 words unintelligible to the everyday citizen in an Internet world. It isnt the USPTO’s fault as was disclosed in the post session Q&A. The employees of the USPTO are the Implementers of rules and regulations crafted over on Capitol Hill by Lawmakers and staff. Who do yell at? Not these people doing their jobs, following rules written by GC’s, staff and policy makers who would benefit by getting out in the real world and focus testing their rules before the rules hit the real world.

Things have changed in Regulation Writing. Something called the Internet has come along and been a game changer when it comes to Exclusive Clubs such as Lawyers being the only people qualified or wanting to file papers with Regulatory Agency’s. With a plethora of online Do-It-Yourself papers provided even by the USPTO, the Register of Congress and Staples, the common sense no brainer would be to have written the America Invents Act and accompanying papers in plain old English or, using the word of one of the USPTO staff panelists…. SIMPLIFY.

While the Register of Copyrights failed to define Author in its Title XVII, the USPTO got it “ OMG, don’t they know?” reaction to the follow up line of  Author’s or Originator being defined as First To File by what is found on line supporting a person’s claim to being an Author. Now, meanwhile back at the LOC ranch where the Register of Copyrights hides out is the effort underway to pushing a new marketing cash making effort, coincidental to Facebook and Google et al wanting to claim ALL online IP as theirs. The initiative? Called Orphan Works. Orphan Works? An original 2D Arts IP appearing to have lost its daddy or mommy hence the moniker, Orphan Works which means the premise of finding someone’s FIRST USE online maybe slim to none or someone pretending to or having mocked up a “REAL DEAL.” Photoshop anyone? Has no one been watching the news about warphotos layered to create battles whe
re one did not exist. Relying on the date bottom right corner of a page printed from the Internet as confirmation of date of first use? Faulty too. Has no one on Capitol Hill heard about fake websites or online pseudo personalities telling people they won a Nigerian lottery from a prince who lost his way?

Well it seems it hasn’t. But this isnt new for people wanting to secure a Patent or Trademark by ‘creating’ first presence in interstate commerce. Used to be Copiers were used or waiting at the corner of  Mulholland at Mike’s Garage to get a “certificate” the ancient car passed its Smog Inspection.

The dollars and sense of the process was quite clear… you want something faster, going to cost a lot more to fast track a prioritized examination with a final decision in 12 months, in closer to 5 months…. $4K.

The greater concern of what hath Capitol Hill missed. That a scientist crediting himself for changes to the process the USPTO has implemented standing up in the Q&A putting forth a recommendation the panel moderator thought highly enough to LIKE said a lot. Crowdsourcing, Capitol Hill, beyond the core of Usual Suspects who fundraise on getting mentions for appearances on Capitol Hill…. ask the Scientist or Interested parties who actually tried, succeeded or failed with efforts to protect IP and, as was answered to an audience question- protecting the Time, Dollar and Emotional Investment, oh, and lawyers fees for an idea that will get stolen within seconds of being published, still, Traditional Tuesday, Patent Release Day at the USPTO.

Did you know the USPTO publishes patents at 2:00 Virginia time while good little Americans are fast asleep and people around the world, like in China are wide awake? What was that about China stealing American Intellectual Property? Come again? A mentor taught that Tuesday was Russian Day at the USPTO. As he described, doors would open up 9:00am at the USPTOm and as he described the Russians would march in with paper bags folded under their arms and, at 5:00pm, walk out with the bags packed with printouts. Now, CLICK at 2:00am, and the Virtual Shopping Cart is checked out…. To people no one knows.

Patents being stolen Congress? Nope. The Mentor tweaked a prior perception. Publishing a Patent is a BRING IT ON CHALLENGE to doing it better. American is giving away IP, citizens have paid a lot of money for. In the Internet Age? Thousands of dollars is gone in a second.

The panel fell back on the value of a piece of paper in pursuit of a Patent Violation. Heard it all before, in Copyright, Trademark and all areas of IP. That paper is as good as having bought a plot of dust on the moon. Worthless, if there isnt equity in the matter that a lawyer sees to take something on Contingency. Oh wait, this is IP. Contingency? Fat chance and when pigs will fly. Never going to happen. How many ordinary citizens have the bank to risk their house on an online theft by Mr Mysterious?

There is an option much of the room had not known before, not sure if it is published in the America Invents Act. Inventors have the right to ask that their Patents not be published. How about this? Flip it. Make it mandatory that the Patent NOT be published unless the Inventor makes that request. Give America back a chance to be exceptional!

The micro-entity Status/discount resonated potential for Tax Fraud in the arena of Institution of Higher education and researchers. The definition of what an Institution of Higher Learning is but in the conversation about the Inventor… “Inventor, not a university employee, has assigned his/her invention directly to the research foundation and the research foundation provides the University, an IHE, a non exclusive, non transferable royalty free license for research use to the technology….” Think it explains itself…. Just in case, what did the inventor get as a receipt for his IP and what did the Research get in receipt from the IHE.

Its not that the men and the women of the USPTO don’t know the games people play. They do. They wouldn’t be working at the USPTO if they didn’t. But as one of the attornies acknowledged in our sidebar……. ‘What can we do, they,’ tilting his head towards DC, ‘they write the rules, we….’ His voice trailed off.

Nice people at the USPTO who wont deserve the next Tsunami of criticism once the Thing That Used To Be Called Media finishes with Obamacare and is looking like bloodthirsty packs for a new victim to rip into…. In an effort to head the mob off? Go after the policy makers, the Think Tanks and the GC’s who need to try a new tactic…. Call home and ask Mom, if she can understand what the highly paid experts have crafted? Why Mom? She represents a demographic of inventors that give good honest critiques, like the two women in the row behind me who made the pilgrimage to the AIA First-Inventor-To-File Hands on Patent Filing workshop, anacronym HOW Second Anniversary Forum…. They couldn’t figure the complexity of the text out….. either

Oh… panel planner? Next time print the site adress on the reminder email…. Wink. Peep? Don’t chew out the USPTO. Take the initiative and write the AIA or the forms and directions out in Real English to give Congress an Idiot Proof Example of how a Lawyer or Wonk would sound if they got off their Capitol Hill horse and hung with the homies….

COINCIDENCE FB FRIENDS REALLY LIKE YOU or IS FB FRIEND BUMPS FB LAWSUIT PREP BY THE DEFENDANT: FB users are reporting mysterious bumps in the numbers of their FB friends days before mediaites released news on FB & pending lawsuits for the NASDAQ & FB IPO bungle. One FB exec left America before the IPO opened then fell like a stone collapsing farther upon reports information on FB's more correct valuation was released to big investors but withheld from the general public. Days after FB users began noticing & sharing the 'weird' bump in FB friends in some cases pushing FB Users over the 5K max limit of friends, news began circulating the internet that FB is in litigation prep mode. Did the FB booking it from America signal he was aware the public would awake from their KOOLAID stupor for the stock I predicted was a Cabbage Patch kid or Pet Rock craze?

Is the bumping of FB user FRIENDS numbers a ploy to alter potential evidence in the imminent litigations towards changing the 'valuation' of the stock/users/members that could be used to bolster the alleged valuation of the company? I recall disbelievin an IT guy from the Isle of Man told me how wages were being dropped AFTER horses left the gate. And then years later that scenario happened at NYRA.

Will enough FB users have the moxy to Screen Grab their FB Timeline which shows the number of FRIENDs in order to assist Congressmen Markey & Barton, and the FB users own Congressman & Senator, on the CONGRESSIONAL HEARING FB users should anticipate will take place to avoid another Solyndra destruction of evidence taking place. With all of ones lives in hand in a political climate where Social Networking dominates there is alot to be looked in to and alot to be done starting with Screen Grabbing/dating  FB Timeline pages of FRIENDS & even FRIEND lists before it disappears.

THE ART WE ARE LOSING- BEAUTIFUL HANDWRITING

MacBooks and iPads won. We losing the Art of Beautiful Handwriting. Despite one of the most popular giveaways at tradeshows still being pens, flash drives are eclipsing pens as swag.

Decades ago, bar mitzvah boys announced at their celebratory dinner “today I am a fountain pen.” Serious. My brother did just that.

Fountain pens are going the way of the quill pen and an endearment scrawled in the sand. Mitt Romney chose a huge heart as big as his love for Ann. Mitt wrote “I love you” in the middle of a sand drawn heart, way back in the days of pens and pencils and $300 Montblanc pens. I recall being enchanted by stories of birch bark being used by Indians to write messages on. I would craft a teeny birch bark canoe then scratch a message on the boat side before launching it down the “crick” deep in the ravine we played in.

Handwriting is an art. It has been lost. Even I find moments and days my “gton” in “Washington” scrawl together in an unrecognizable scritch even I cant recognize. Readable printing or cursive handwriting are no longer a requirement in school curriculum. Trayvon Martin’s 19 year old friend not being able to read or write cursive got lost in the drama of a trial over zealous people with MacBooks and iPads are using to push a post trial verdict riot. Cursive can connect the dots- character and accomplishment and challenges to overcome. Cursive can connect to success.

Illiteracy has not been wiped out as politics and media promote. Trayvon’s friend is a product of Teachers not teaching a historic craft and a culture that creates its own lingo like cracka. “X” not only marked the spot where pirate treasures were buried. “X” was used by illiterates to sign on to legal documents. Writing was an art utilized by the wealthy. Merchants who could sign put their name to the paper. The masses were taught writing by the churches, in bibles and in schools that evolved from Sunday School teachings. Illiteracy will only get worse with text abbreviations replacing complete words, LOL.

Flash mob, my foot, is not an innovation of modern technology. One click of a tablet button may drive together a flash mob of illiterates looking for a brainless moment that took days of a historic horseback ride for Paul Revere to sound the alarm for.

I have taken my stance. My favorite note pad cover is decorated with a pencil and eraser and the phrase “There Isn’t An App For That.” There isnt. Each push and pull of the pencil if slowed to a momentum of curves is gorgeous in the making. It is thought. It is pause. It is beauty in the making, a challenge bringing together mind, memory, hand and eye in the skill of words I choose to remember. I am after all the author of a book on Scribal Arts, Hebraic, letters within which lives lessons of life. I write an “A”, I see a world I used to lose myself in. Anyone know what a Rapidograph is? A Triple 000 nib. An inwell? I do.

My 7th grade teacher, Mr. Fenn, a man from Wales, taught our class to write with fountain pens. We were encouraged to practice. Good letters, good handwriting were doors to open futures with. That said, the con man who collected pens of all types, may have owned fancy pens. What he lacked was the bravado to write beauty with. What he didn’t realize that people remember what they write down. Once he sent off the damning email, he forgot all about it. The handnotes he penned stood as reminders of his con-in-planning. That is the thing about handwriting. Unlike the skills of listening and speaking, letters stick around as memories- good and bad.

I recall being twisted in to my desk to break my of my habit of writing backhand. To this day, my “4’s” look like “21” and my “7’s”? We wont even go there. And I remember my gift I have to this day, from JP Magnier. I sent a photo of his horse at Cheltenham, its last ride. It tossed its shoe missing me by micro inches. So I sent him a print capturing history. And what I got in return is a pen…. A reminder that iPads and MacBooks may replicate letters of all types of styles and fonts but they will never give me peace that comes with pencil on paper or pen in a notecard or love letters to treasure….. there isn’t an APP for that… but if time was taken to take students back to basics, to teach the Arts of Beautiful writing, some may discover they have an App, an aptitude for that…

Over a year ago I stopped by the Judiciary offices. I learned quite suddenly how little legislators and their staffs knew of real value of 2D IP, Intellectual property to the Arts Community, or of 2D IP creators Identity, too. I am understanding artists of my background- the licensing world- don’t often walk in the door saying, “Hi, I am here and this is what I am not hearing presented to Committee.”  Staff and legislators speak to CEOs and professors mostly, it seems, when it comes to policy making, and wonks and lobbyists too. Art school humor, let me share- Thems that do, do; Thems that get jobs like CEOs and professors with paychecks and perks who get paid whether or not the © Copyright Protection Ball for the 2D arts gets moved forward.

Then someone told me last week (a wonk, of course, who knew about the hearing only when I told him about it- paycheck dude) that the Judiciary is going to take at least two years to knock out a Bill on Copyright protection.

OMG. Not on my watch.

I am a commercial artist by training. That means, I got an assignment, I got it done, NEXT!, always moving things forward. That is how I earned my living, as a female small business owner who raised three sons into professional men, by doing what I loved. I many not have been the best in my field. I may not have been the most successful. I loved it so much I tell people I have yet to work a day in my life.  Decisions got made. Tradeoffs were considered like when it came to moving my programs overseas, I balked. My number one job was MOM. Kids came first.

I wouldn’t have given up my “Mom Job” for anything in the world. It wasn’t easy doing it on my own. There were nights I fell asleep at my art table. There were things I didn’t do for me because I wanted to “do” for my sons. The more I worked 24/7, 12/365, the more I was able to provide for my boys just the same as other parents who took entrepreneurial gambles to work at what they love. I worked hard to create 2D IP, I owned in order to provide for my future and for my children. Being my own boss with a professional ethic was all that mattered when I connected to clients around the world who all they cared about was that I met deadlines then shared profits we made. I was a voice on the phone, a signature on a paycheck, a name in a designer ad. And once in a while when I met employees of my licensees, I was a rock star. My employees, my art, made sales staff gush. Our being successful wasn’t contingent on gender or color as some blame their status in life. Our work ethic is what counted. Our work at home success wasn’t impacted if we were black or white or plaid or blue, disabled or sickly or male or female.

Owning my 2D IP and my IDENTITY hence my COMMERCE allowed me to be a stay at home mom, there when my sons went to school in the morning and there when they came home at night, a REAL small business person- just like all the artists, writers, dancers who follow their hearts- that your staff don’t put before you nor explain the dire straits of their lives now and why we cant wait two years till you get your Acts together.

Our children’s values come from learning our ethics and values coming from being self starters, owning what is ours. My sons grew up going to trade shows with me thinking every child met Clifford the Dog or the Teenage Mutant Ninja turtles. One of my sons has come back to the industry of IP as a lawyer.

Who am I to ask that question? I outsold Disney on like product at Point of Purchase without TV promotion or other so what makes my art less valuable than THE MOUSE. Let me let you in on a secret, Disney’s success in bottom lines? Youtubes? Googles? And so on? Comes from raping our content for investors’ gain.

We freelancers, independent small business Arts peoples don’t get pensions, we don’t get disability, we don’t have weekly pay checks the SSI office asks for to qualify. When we cant work, we dont get paid. END OF STORY. Ask us how we feel covering people clamoring for disability or free Obamaphones when we pay for ours out of diminishing earnings as you give more latitude of our 2D IP, ID and Commerce to technology racing ahead? Our 2D IP, ID and Commerce is the juice that makes their engines rev. Let me repeat, OUR IP and ID and Commerce.

Your laziness in making timely decisions to protect the Innovative Entrepreneurial Communities is killing America. It isnt jobs Americans need, it is owning every single solitary bit of their intellectual property that your lawmaking keeps giving  away to technology. What are you thinking? And what are you thinking now when it comes to letting entities like FaceBook and Google rotate in and out of your offices without holding them accountable to Identity theft, violations of Unauthorized Use of IP and even of Fair Use. The money offshore- Googles and Apples billions wasn’t made from their creativity, it was made from misrepresenting a product to consumers IN ADVANCE without advising in plain simple English that “we are going to stalk your life, then sell you to the highgest bidder.” Gimme a break when it comes to Human Trafficking- if selling my name on 123people.com or spokeo.com and other such site Human Trafficking at its basest level THEN WHAT IS?

It is really simple. We don’t want jobs. We want our IP. We want people to say ‘Please may I’ before taking our stories, our dances, our songs, our designs, our photos, our poems, our website data, you name. We want to control how they use it. And no, don’t even entertain Small Claims court for 2D IP creators. Ever pay attention to the cameras in the well in front of you, sounding like machine gunnery blasts. THOUSANDS of images a day. Really. Institute a dedicated IPR court with a REAL LEARNED IPR judge presiding rather than someone who took one IPR course in law school.

So the next time the Internet Association or the Electronic Frontier or Google walk through the door, ask them the tough questions about the Property they are stealing from the 2D arts community? And don’t back down.

They wont answer so fast. Theft is theft and theft is criminal. No. We don’t want the pittance like Arianna gave to her free content providers. This is different. We aren’t giving our 2D IP to the Search Engines and ISPs. They are just taking it and you wont make them stop.

Ms. Chu, when you called out WHERE ARE THE ARTISTS, they were on their knees in the well in front of you. All you had to do was peer over the wooden desk, smile, wave and say, “hello, how are you, who are you”, my lesson learned from Samuel Jackson from my LA days. Try it some time and ask that  photographer- day rate or staff? That will get the Missing Artist conversation going.

My peer are a good starting point help Legislators learn firsthand from 2D IP creators answers about Artists financial health- that some do, some don’t have insurance- life, car, health- most don’t have pensions, most don’t have savings, most don’t even own their own gear. Some are salaried. Most aren’t. Some are on assignment. Some are on day rate. Some used to make a living at what they love. Not anymore. And if one of us gets injured- short of nest eggs from prior careers, a working spouse or a sugar daddy or mommy as the case may be- I could be blunt- I will be lady like- they are screwed. Ask them how they afford replacing broken gear and/or body parts. You can gerry rig a camera or flash but…. bodies usually makes a snapper a “retired alum.”

What you weren’t asking the witnesses at the last hearing was how is Getty wire service surviving with technology nipping at their heels;  or to answer honestly the real reason they HAVE to keep on chasing new clients (not that they don’t want to) is because your decisions giving the search engines and ISPs latitude has devastated our industry that within seconds of selling a One Time Use of an image it is EVERYWHERE without payment moreso with little incentive to recoup losses because the average thief is probably close to your home. Ask them how much they were making PRE INTERNET and then Post. Remember the use of Ms Pelosi of Paris Hilton, the Monopoly Money Man and other celebs to make a point? Copyright law is broken even by Congress when you hustle a pic off the net to illustrate your message. Remember the Shepherd Fairey “Obama HOPE” lawsuit. AP has deep pockets. Ask your staffer who gave them permission to use RGIII as their avatar. Ted Leonsis says it’s the cost of getting fans to become fans. The cost of using a sole proprietor disabled entrepreneur’s 2D IP? Ask one the next time you meet one.

This is our message. We don’t want to end up disabled and on the dole. We don’t want to end up on the streets or in the poorhouse. We don’t want to borrow money to survive. We want to pay down school loans. We want to buy houses. But the rate you are giving our 2D IP away we have one reality looming on the Wall- the poorhouse or stop creating. How does one turn off a passion?

We don’t want jobs. We are exactly who we want to be, Small Business People Entrepreneurs. We respect your work. Now respect ours! I know for me, one morning I want to wake up hearing the Entrepreneurs report not the Jobs report. Future jobs in America are going to come from entrepreneurs if you stop the theft of our Property Rights- 2D IP, ID and Commerce.

The fire spread too fast with an intensity that resonates arson. A historic building was destroyed. Buildings can be replaced. Students visions and dreams cannot be replaced. They can be. Been there done that with loss of art. The heart breaks but visionaries have a talent for coming back even better. I had sent the art for my calligraphy book to be copied by someone I learned later in life I should not have trusted, short of three amazing ‘portfolio of life’ pieces, sons. As life predicts, upon receiving the call from my publisher the box of my art disappeared without a trace, I made that LIFELINE call. That was when I learned the art, all original without trace offs archiving process, had not been copied as requested. I did what all visionaries do. I cried. Once the shock was over, I sat down to fulfill my obligation again. Every stroke of the pencil on paper hurt. Round one of illustrations flowed from my inner creativity well. Round two was painstaking as I was trying to recreate. I learned that as much as it hurts, the memory of loss, what was gained was knowledge of a life lesson I carried forth in to the world- sometimes Do Overs are Do Betters. My book has remained, from Day One of publishing, the top of its class. But the memory of loss getting me there, remains, as it will for the students ravaged in Pratt’s fire which is shades of arson.

I had been at my Alma Mater’s campus a few weeks back exploring Options. I have thought about teaching, now that the career path ahead of me is open to options. Pratt celebrated its Anniversary. I made the pilgrimage to a college that I, in fact, had been to once in my life, back in 1975.


The Dekalb Avenue station was lit with a single naked bulb. I had just moved to New York. The night before I had watched Charles Bronson’s movie of rape and snakes and…. You know his formula. Elevators scared me. The first booklet put into my hands, at Pratt’s Brooklyn Campus, a WHAT TO DO IF booklet- if raped, if busted for drugs, if- the list that went on, was enough to scare me to attend the Pratt Manhattan campus- the newly aquired Phoenix School of Design, at the corner of Lex and was it 30th or 32nd, familiar stomping grounds for me as it was down the block from the Women’s College I attended for one year. They promised art and dance in their curriculum. They gave neither. A year and a marriage later, I was back in the hood, in the heart of New York, in the crosshairs of history and creativity. My career began. Because of me.

I had wondered how Pratt could place students in the heart of Manhattan- yards and telephone calls away from those would either employ or deploy us- publishers, design houses, magazines, agencies. Wednesday was Drop Off day, the day magazines would open their eyes to viewing for potential new talent. My illustration major teacher, when I told him I dropped off my portfolio at the New Yorker, could not contain his laughter. When I picked up my portfolio case weighted down by the single sheet rejection letter, I could not contain my tears until it was pointed out to me that the letter did not say “DEAR CARRIE who thinks she is better than she is…” The letter said starkly, simply, “Thank you it does not meet our needs at this time…” still an ouchie, but more of a point than a jab. My illustration major teacher didn’t think much of my idea that we students be taught the rejection while in class where we were able to discuss how to do it better.

That was 1978.

Fastforward… 2013. The class Business of Business is still not taught, not even on main campus in Brooklyn, I was standing on the ground of in my pilgrimage to past. I think I may have been the only Pratt Manhattan Center student there in the cluster of Black & Gold Brooklyn patriots. I couldn’t share their stories of being held up by gun, rapes on campus, all the things that scared me off of commuting from Spanish Harlem to the naked lightbulb at Dekalb. Students are being turned in to the world incapable of understanding the reality of covering bills, turning ambition into bank account deposits and how to tweak in a world of fiscal collapse MORESO for creative sorts who dream. Innovate. Entreprenueriate (wink). I missed out horribly on being on a campus that was rich in history, little of which was present at Alumni Week, other than a tour I arrived too late to participate in but soon enough to get a sense of self that I was one of THAT 2% we students were told of, that would graduate then continue to work in industry. I started with a piece of artwork in a Macy’s downtown bathroom display. How cool is that moving my career forward from the toilet to the world of bunnies & mice & bears then back to Brooklyn where I saw a world I was envious of. Technology was sweeping the arts. I recall being threatened and told if I took a course at SVA or FIT that I would  be bounced from my certificate program so I did as a girl yet to learn the power of NO did… I didn’t. My heart pangs the times I am in New York passing SVA School of Visual Arts in a cab or FIT Fashion Institute of Technology down the way from the Bronco Bar. Or is it Mustang Missie’s. Who can remember at my adage… I do side with the paper and pencil set over PDAs that darken when the lights go out, more and more frequently these days. I will never die bored even if all I had was a twig and sand to draw in… and a something more… a sense of belonging to a campus, I told our president Thomas Stutte at the reception hour before I tuckered then called to be picked up, how can it be that PRATT INSTITUTE does not have a license plate frame. I want to belong to the culture of drivers on the road who advertise their brainiacs telling their tie to higher education- parents of, son of, alumni of…. It beggared my mind the Design School of Design Schools had no License Plate frame. I told Thomas I would design it. He said email me. I did. That was October. He forgot my adress until after the fire broke out this week. Then he didn’t remember ME. He remembered how to ask an alumnus for dollars…..

I had asked to meet with Thomas, too, on another matter of importance to our college beyond Tag Holders and wanting to create the course curriculum for Teaching Students the Business of the Business. That was October. Follow up email. No answer. Until the fire broke out. He remembered my email. Not our conversation. Not my offer. Not my request.

I am proud of being part of Pratt. I am proud of being one of the few on our Alumni LINKEDIN forum. I monitor. Rarely post. The most interesting conversation was that of Who Is Working In Their Field of Learning. 2% still. Me. Here. One of 2 PRATT ALUMNI that LINKEDIN acknowledged for being in the top 5% of  most highly viewed LINKED IN PROFILES.

And now. Sharing the student experience of an alumnus the college finds only when dollars are sought. I thought my voice and experience and accolades add up to more than a sum total of what used to be wet ink on a check. The Gothamist link woke me up to speak up. There can be no moving forward if there is no history to look back upon with pride.

Thomas, my offer stands on the table. I will design the license plate holder to make PRATT ALUMNIS proud, a fundraiser, an awareness raiser. As for Copyrights? I did what I told you I was going to do.... stand up for Copyrights alumni live off of. Next time in New York, I mean me in New York sir, lunch at your place.... in the shadow of the rebuild, as does the Phoenix Rise from the Ashes, we can talk taking the lead in the Battle of Copyright Ownership from the Free Enterprise Internet. Lunch is on me sir, considering we have a historic building to rebuild.

There were the Rose Garden student invitees from around the world, memorably, the young man flaunting his kafiyah back & forth over his should while walking up & down the white folding chair center aisle…America brings students over as cheap labor for resort areas ie Chincoteague summer shops or Juice shops on Connecticut Avenue. Some leave. Some stay. They all have something Americans don’t have- a home 2 go back 2 when either the going gets tough or the money is rolling in as is w Eduardo. Brazilian born he lived the American Dream of being an entrepreneur & now America is angry @ him. In all fairness of perspective he isn’t one of the students that came over 2 learn in America then returning 9-11 on airliners taking American lives & icons out w them.

He made money.

People are now jealous that he gamed the system, that he was part of the FB FRIENDS that hung out w a man that wasn’t part of the in clique. We used 2 call them NERDS. Isnt this the ULTIMATE REVENGE of the NERDS. He made his money & booked it. There are 2 ways 2 go from here- complain & come across as International Crybabies who didn’t make the money or take the lead & say THIS is what America is all about- where everyone has potential 2 achieve greatness & financial wealth. First step of course is weaning the 1000s from the State Teat w a course Eduardo can pioneer- How I Made My Millions & Had The Business Savvy 2 Keep It….. If ONE example wraps up the argument on why America is trailing countries in the world w more American industry going off shore EDUARDO should  become textbook for what AMERICA is doing wrong & did right…. Wrong? Undervalued him.

Heck he is walking away w billions. He gamed the gamers. He outsmarted Congressmen a lesson that stands well for both industry & terrorism. It isn’t the ones you have been told 2 look @ 2 fear. It is the 1 you don’t see coming you need 2 be prepared 4. & they are invisible. & everywhere. For risk of sounding unpatriotic in lifes chess game Queen to your Bishop… King.. Crowned… LIKE!
