Bill Gates wrote, in 1996, “For the Internet to thrive, content providers must be paid for their work.”  

Speed or quality of bandwith is just part of this conversation. Cant talk broadband without talking what is being sent through the cables and over the wires- content, stolen from Creators. Creating content has become a misnomer. leapfrogging past the days of blue Hyperlinks. The Internet’s interpretation fo “Creating content”, today, is blatant back door theft of Content ARTS creators post to websites, clearly marked “May Be Used Under License Only” or the symbol ©(creator’s name.)

Pay all Content providers for their work. Pay each artist, photographer, writer, singer, musician, website creator, parent who posts family photos to Social Media and site creator whose content is removed without permission violating the law of the land. Each of my thousands of images on Providers Search Engines is a violation of Fair Use, not protected by Safe Harbor and depriving me of payments. Control? Gone. We have no idea how many people have taken content from each provider image site page. Copyright is Property. The Internet was intended, by design, to take People’s property and defraud them of its Control and Commerce, profit.

I betcha the Providers do. They count Clicks. They track Users.

Gates wrote, “Content is where I expect much of the real money will be made on the Internet.” Content creators aren’t making that “real money.” Providers wanting more of an open internet are.

Congress must limit consumer access to content that has been stolen. Require Providers’ to warranty they have license and paid to use the content going through their wires, a use of content in itself. Here is a good reason. “Criminal intent is a necessary component of a “conventional” crime and involves a conscious decision on the part of one party to injure or deprive another. It is one of three categories of “mens rea,” the basis for the establishment of guilt in a criminal. There are multiple shades of criminal intent that may be applied in situations ranging from outright premeditation to spontaneous action.”

 “The intent to commit a crime: malice, as evidenced by a criminal act; an intent to deprive or defraud the true owner of his property. People v. Moore. 3 N. Y. Cr. R. 458.  (source: Black’s Law Dictionary)”

All this talk about Free Internet is dust in Congress’ eyes. Shall we say Ireland, Caymans, Luxembourg, for starters. Let’s get real. The conversation is global. The Internet here in America travels internationally. All the providers are international. American laws are meaningless on their own. Any decision made here in Congress, other than NO, is wasted time.

There is no such thing as a free lunch. And as Gates wrote, “the incentive for Internet distribution that copies are made “at basically zero marginal cost to the publisher.” The price we paid, unknowingly, is we all got algorithmed, stalked, promised rental cars as low as $6.95 when not one quote comes in under $30; we lost privacy being shared across platforms not being told that when you enter data into one Flight departure that as you visit “unrelated” sites, all that data you entered in the first site pops up ‘magically’ in each the other with price quotes within a dollar of each other. Collusion? Conspiring to manipulate a market, sound appropriate.

Gates described the Internet as “multimedia equivalent of the photocopier,” with “No company is too small to participate.” How does “free” grab you? It costs nothing for either a company or a person to go on to the “Image” click of AOL, Yahoo, Baidu, Bing or Google, to right click a photo then drag it to a desk top.   Gates was correct writing the Internet allows material to be “duplicated at low cost, no matter the size of the audience.” It’s not the companies alone perpetrating the crimes of property theft. The individual User, the soccer mom, the student, is the consumer is set up to take the fall. On internet, thieves are everywhere, unseen.

The mission statement of the FCC is  “Promoting competition, innovation and investment in broadband services and facilities; Supporting the nation's economy by ensuring an appropriate competitive framework for the unfolding of the communications revolution; Encouraging the highest and best use of spectrum domestically and internationally; Revising media regulations so that new technologies flourish alongside diversity and localism; Providing leadership in strengthening the defense of the nation's communications infrastructure”

 The FCC is failing its mission. The FCC OIG aught to investigate how this agency got out of lock step with the law. The FCC may be a neutered agency limited to slapping wrists as punishment. The need for something greater, faster, is now. How about the word, NO!!!!!

The Providers that built the Internet are dodging this bullet.  There is something wrong with America’s judicial system. There appear to be two different sets of laws. Teresa and Joe Guidice of Real Housewives Of New Jersey fame are facing jail time for false communications sent through the mail. Wire fraud and mail fraud were two claims launched against Bernard Kerik, too

Gate called the Internet, a “gold rush atmosphere today is primarily confined to the United States, I expect it to sweep the world as communications costs come down and a critical mass of localized content becomes available in different countries.”

Well, the future is here. Theft is still theft.

Gate recognized decades back the impracticality of charging consumers for content. Gates wrote about the “hassle of electronic transactions.” He wrote, “A major reason paying for content doesn’t work very well yet is that it’s not practical to charge small amounts.” Gates predicted 1997 would be the year, “mechanisms will be in place that allow content providers to charge just a cent or a few cents for information.” Gates recommended getting charging the consumer on an aggregated basis. Knowing and seeing are two very different things. Global citizens are already drowning in credit card debt brought on by credit card swipes.

The Internet provides site/page providers the ability to put a Debt Clock on a computer screen top letting consumers see how much each click increases the monies they owe. Without a personal debt clock, consumer bankruptcy will increase while Internet associated companies will get fatter off consumer use.

It is no mystery. Consumers are the Content, today.

The Internet is violating laws facilitating stolen property, Intellectual Property, copyrighted materials, bundling of ID’s aggregated in to Identity stealing quantities. This is not what Internet Users want. Mark my words, these chickens come home to roost in that the Internet thief today, will be an Internet victim tomorrow.

Paying for broadband does not entitle subscribers to use stolen quantity.  Slow lanes? There should be speed bumps towards mitigating online theft. A speed bump would be a pop up stating you are entering acknowledging that the broadband host may be providing content to you they will let you be the fall guy for the theft, hiding themselves behind false claims of Fair Use and Safe Harbor.
 
Net neutrality is a misnomer. The Internet is not neutral. The Internet isn’t open. It is maliciously designed, controlled to be deceptive from its inception, using psychology to study human nature to groom people to love the idea of “free” and “LIKE.” If the Internet was neutral then we could take Bill Gate's 1996 Microsoft speech, ignoring its (c) 2001 Microsoft and not worry about being sued. How much of a gambler are you?

Providers need content to survive. But content belongs to creators. Online or off, theft is theft. Users don’t need new laws. Users need legislators to use common sense with a strong stand for Title 18’s protections for Title 17, copyright.

The FCC must acknowledge it’s role and culpability in facilitating Thefts of Properties, internationally. The theft is global. The Internet was not always called “the Internet.” Let me step you back a few years… to its earlier name.. the World Wide Web.

What was that ditty… “Oh what a tangled web we weave when we try to deceive?” You get the point…. This deception is tangled. Roosters are coming home to roost.

There is only one thing to be said about recent global Court rulings knocking the foundation of Silicon Valley’s free model. It is about time. This “free street” of information goes both ways. Consumers want to know who these companies are, who is accountable, where stolen content profits are banked. Content creators want reparations for their losses. And they are going to get it.

The world is fast enough. Why does it need to get faster? Gates wrote, back in 1996, content companies making money through advertising or subscriptions, wasn’t working then and it may not for a while. Hence, the push for more data.  Some things will never get up to Internet speed. Nor should they. The wheels of justice grind slow. Sometimes NO is a good word. No, would be acceptable here. My grandmother used to say, “What’s the hurry?” What is the hurry, technology? Where are they going? Where has our content and our profits gone? Be open, Open Internet, that Silicon Valley seeks.

Microsoft appears to have removed from Gate’s statement from its site. I wonder. Something about words coming back to bite ‘ya. Something about the web, where nothing ever disappears….
