AUTHORS: (In A Copyright Use): Merriam-Dictionary definition of “Author” is he one who originates the Work. Copyright Law as it stands today does not clarify if the Author is Animal, Algorithm, Person, Team of People, Corporate or Individual. Amazingly, Copyright Law, Title XVII uses the word “Author” over and over again but does not define “Author.”  In the regular world an “Author” is someone who wrote a book or an article or a poem or a Haiku or a tree scratch or Love Notes in sand. See where I am going…. Into the ARTS world where “Author” is defined in Section 101 of the Copyright Code, Title XVII aka Title 17, as, OMG, with all the definitions listed in this section the word “AUTHOR” is not defined but it is referred to over and over again but we can get the jist of the Code’s intention if we look at Section 102 adressing Literary Works, Musical Work including words, Dramatic Works including music, Pantomimes and choreographic works, Pictorial, graphic, and sculptural works, Motion pictures and other audiovisual works, Sound recordings and Architectural works. Merriam-Webster Dictionary defines “Author” as “one that originates or creates : source…” I use the term, “CREATIVEs”

AUTHORSHIP: Merriam-Dictionary definition of “Authorship” is ‘the source of a piece of writing, music or art’ or ‘ the state or act of writing, creating,or causing ‘

AVATAR: An AVATAR is the Internet Word for a 2D ARTS concept known as a Thumbnail (refer to Thumbnail). Avatars or Thumbnails of Other Peoples 2D (dimensional) ARTS IP (intellectual property) is used for the most part without permission of the 2D (dimensional) ARTS IP (intellectual property) Owner. It has become a sad reality that most entities have given in to the tsunami of loss of their 2D (dimensional) ARTS IP (intellectual property) on the Internet with a ‘what can you do’ attitude in that it appears Legislators have dropped the Copyright Ball when it comes to applying Common Law, Code, to Technological Entities, facilitating thefts (do I hear NAPSTER anyone?)

BUNDLING: Bundling is the bringing together of items or services sold for a single price or on more products. In the Internet Age, bundling is used to describe the bringing together of a Person or Entities data, including but not limited to Image, Avatars, email addresses, home addresses, phone and cell numbers, stories the person may have written, Photographs they may have taken, Works they may have created but done so mostly without the person’s permission or knowledge until they find their ‘bundle’ on the site. Take Down notices are often published on sites like Chilling Effects without the Author’s knowledge or permission a violation of the implied Confidentiality of the Take Down respect

CALIFORNIA CIVIL CODE SECTION 3344:  California Civil Code Section 3344 was created to protect the Publicity Rights of living persons

CASH PARKING: Cash Parking is a violation of
ACPA, the Anticybersquatting Consumer Protection Act. ACPA. Cash Parking allows registrants to purchase domains that resemble well known sites (i.e., AcademyAwardz.com), “park” the website, and collect a portion of the advertising revenue generated on a pay-per-click basis.  

CELEBRITY IMAGE PROTECTION ACT: The Celebrity Image Protection Act also called the Astaire Celebrity Image Protection Act gave Post Mortem statutory rights, seventy years Post Mortem, to the Estate of a Deceased Personality where “that personality had been "any natural person whose name, voice, signature, photograph, or likeness has commercial value at the time of his or her death", any person using such personality's "name, voice, signature, photograph or likeness on or in products, merchandise or goods" without prior consent was liable to be sued for damages and profits arising from the unauthorized use, such prior consent may only be given by persons to whom the personality had transferred such power by contract or trust prior to his death, or by trust or will after his death, or, where no such latter provision was made, his spouse, children, and/or grandchildren, "a play, book, magazine, newspaper, musical composition, audiovisual work, radio or television program, single and original work of art, work of political or newsworthy value, or an advertisement or commercial announcement for any of these works, shall not be considered a product, article of merchandise, good, or service if it is fictional or nonfictional entertainment, or a dramatic, literary, or musical work." This law is the Model from which to protect Victims of Terrorism, Military and General Persons from being abused after Death for profit or Activism, by non-entitled persons, non profits, governments and or others

CELEBRITY RIGHTS ACT: The Celebrity Rights Act was passed in California in 1985. The Act allows for a Celebrity or Personality’s Rights to survive after their death 

CHAFFEE AMENDMENT: The Chaffee Amendment is also referred to as Section 121 of the US Copyright Code. The Chaffee Amendment is misquoted to convenience by Individuals and Entities wanting to avoid paying Royalties to Authors of Works. The Chaffee Amendment does not state an Author should not be paid for use of their Work to enable the Blind and Persons with qualifying disabilities. The Chaffee Amendment provides limitations on Exclusive Rights of reproductions for Blind people or people with other detailed disabilities. The Amendment says an AUTHORIZED ENTITY can produce, in special formats, specifically Braille, Audio or Digital Text, for Use by a blind person or persons with disabilities, a Copyrighted previously published Literary Work that is not dramatic. The Reproduced Work MUST state who the Owner of the Copyright is, the date of the Works first being published and that producing the Work in a way other than for the Blind or disabled is against the Law. Authorized Entity is described as a Non Profit organization or Governmental Agency whose Primary Mission is to help the Blind or Disabled. Blind and Disabled is defined by the Act

CIVIL CODE:  The Civil Code are Laws and Statutes dealing with Business and Negligence

CIVIL LAW: Non Criminal disputes such as disagreements over intention and meaning of contracts, divorce, children and property are addressed through Civil Law

COPYRIGHT: Copyright is an Intellectual Property, a Legal Concept giving the Works Creator exclusive rights for a limited period of time defined by Life plus seventy years. A Copyright  is the right to Copy, basically. It also give the Author the right to be credited for their work, along with making the decision who else can use their Work and how it can be used. The Copyright Act of 1976 says a Copyright is protection given to  Authors of original Literary, Dramatic, Musical, Artistic and defined other Intellectual Published and Unpublished Works of Authorship. An Individual’s Copyright lasts 70 years. The Supreme Court ruled that a company’s Copyright lasts 95 years. Disney didn’t want its Mickey Mouse cartoons entering public domain. Lawrence Lessig, a Standford Law School professor, had suggested a play from the Patent Law gamebook that the Holder would pay money every few years to keep their patents current. Lessig said do the same for Copyrights, charge Copyright holders to keep their Copyright out of Public Domain. Some would call being asked to pay to keep a Patent or Copyright out of Public Domain, that Blackmail or Ransom.

Copyright, addressed under Section 102 of the Copyright Code, Title XVII, addresses Original Works in the categories of Literary Works, Musical Works and the Words in a Musical Work, Dramatic Works including the Music that goes with it, Pantomimes and choreographic works, Pictorial, Graphic and Sculptural Works, Motion Pictures, Audiovisual Works, Sound Recordings and Architectural Works.

COPYRIGHT INFRINGEMENT: Copyright Infringement has multiple names for basically the same action of Unauthorized Use of a Copyright Owners Work without Permission. Copyright Infringement, also called Piracy, is Theft   

COPYRIGHT LAW: Copyright Law is in Title XVII, Title 17, Title Seventeen of the US Code

COPYRIGHT NOTICE: A Copyright Notice identifies to the world who the Copyright Owner is. The Universal Copyright Notice is a “C” in a Circle along with the Copyright owner’s name and the year the Work was created in. Affixing a  copyright notice on a Work is optional. Affixing a Copyright Notice to a Work  could deter Unauthorized Use of the Work. In the digital age, Copyright information is often removed by Technology from the Work

COPYRIGHT OWNER: The Copyright Owner is the person who owns a Copyright which may or may not be the Creator of the ARTS Work or the Works Author. A Copyright Owner might be the person the ARTS Work ownership was sold to. ARTS Ownership does not transfer automatically with the sale of a Work of Art unless specifically contracted to Transfer in a written agreement a Bill of Sale

COPYRIGHT NOTICE: The universal marking of a Copyright is a “C” inside a Circle or the word “Copyright” along with the name of the Copyright Owner and, traditionally expected, the Year date of the Copyright Owner. Under the UCC, Universal Copyright convention

COPYRIGHT OFFICE: The Copyright Office is the office of Public Record for Copyright registration. The Copyright office is where Copyright Material is deposited and the records and chain of title for Copyright Records are maintained. The Copyright Office is part of the Library of Congress.

COPYRIGHT OWNER: A Copyright Owner is the Person or Entity that Owns the Exclusive Right or Rights to a Copyright

COPYRIGHT REGISTRATION: The purpose of Copyright Registration is to put into the record an account from an official Government source the date and the Work in question in the event a Legal Claim of Infringement or Plagiarism arises


CREATOR: In Copyright Law, the Creator of an ARTS work is referred to as the Author

CRIME: A crime is committed when a Person or Entity takes possession of or Transfers or Uses the Identity of another Person with their intent being to defraud, commit or participate in an Unlawful activity including theft or Identity Theft   

CRIMINAL: Details of the Criminal Code are laid out in Title XVIII of the US Code. Title XVIII of the Criminal Code follows Title XVII the Copyright Code

Its sort of like house buying, where you go in expecting to buy a house then get hit with all these other unexpected papers, except on the Internet, the User may not find out whose TOS’ they violated until it is too late and Enforcement is knocking on their Internet door

Someone didn’t think this through in that Owners of Trademarks who invested millions over years in to building their Brand, were scooped on securing their Brand’s name on the Internet which the Domain Squatters profited on from, at times, selling the Domain Name back to its Trademark Owner(s). Better deal? Buy a star in the skies or a plot of land on the Moon
