I have been watching the Dan Snyder REDSKINS trademark travesty largely as a 40 year back licensor participant in a fledgeling industry I knew the Dan Snyder issue was the canary in the coalmine for my peer community.
Dan did not. Dan would not. I have met Dan. I have seen sides of him others have not like at the Larry King Foundation event in the basement hall of the Hotel, when Dan softened while adressing his wife's health.
I have moved on from covering the White House and Capitol Hill as an investigative photojournalist. I have not moved on from my art. Art is my heart, it is how I breathe.
Then along came the Hate Dan Snyder collective long before Black Lives Matter and other collectives with drums to bang and an oversensitivity to color and race shadowing Martin Luther King's message for a World Without Color. At a private gathering, the other day a woman read an article so convincingly that everyone in the room was confused when she read the lines about being black.
She was not. She said 'but I am mixed race.' She is- Japanese and white. The angriest people in the room were her black peers. The assignment was public reading. My point being, racial insensitivity colors conversations, more often by people with insensitivity concerns that go beyond color. Color just happens to be the palette they can paint and "raise" off of- money, community, empathy....
A young man once taught me "why do you care..."
I care because I saw and wrote beyond the initial fireworks of a trademark brand. That said, I have met Dan over the years. Dan never struck me as a man that sees the individuals filling the room in front of him. I dont quite know what Dan saw.
The charitability of the Redskins is amazing. That said, the Redskins is part of a 501(c)(6), a business league that pays dues. And each member of that league, men with talent plucked on to the proverbial stage of good fortune like Bruce Springsteen did pulling Courtney Cox from the audience up alongside him, each of those players sets up charities, too, some from personal experience, others from good coaching on how to mitigate tax payments and make for good PR. I have seen Dan's Redskins show up at camps to engage with kids. I have witnessed the genuine fun the players have with their fans. And I have attended DC networking events where sports moguls in DC bellyache about their loss of income from players avatars circulated online by fans. The Redskins and others can afford to turn that cash loss in to a write off and an new 'category' they accept and call 'fan engagement.'
I cant call the loss a write-off nor can most of my peers ARTS content creators so I did what I would expect all right brained ARTS content creators to do- I researched what other potty mouth words were filed in the USPTO and accepted as trademarks.
All I can say is OMG.
I watched the legislators arm in arm storm out of the Capitol to fight for the Redskin rights. They did not mention the numbers of Native Americans proud of having their team. Lets be real, Dan could have named his team the Bagels, the Lox, or the Israelites. Redskins it was, it is and will forever be in the grain of fans. What was struck was a blow against people owning trademarks.
Colorfully speaking between ICANN destroying brands with rampant release of thousands of domain names that can parody a person, firm or brand, that can defame a person, firm or brand with infinite combinations of TLDs a wealthy can pay for, we, are well, F*$&d, better said, gang raped and brutalized. Trademark owners investment is good money thown away. Moreso, the number one cash cow agency of the U.S. government will begin to bleed red when ARTS creators, patent inventors and Copyright filers realize there is no value in filing that fee when you cannot stop the IP assault.
I explained in pictures. I put up screengrabs showing evidence of an agenda. Was it Dan? No. Dan had become an easy target with questionable lawyering advice in beating down the Redskin attacks.
I heard the Redskins attorney was a guest on Sports Law up at AU, American University. I headed up there my articles in hand. I asked my question publicly in to the record then gave my articles to the lawyer who said, story of my life, "I had not thought of that."
This week the papers reported on the Redskins pointing out the USPTO is filled with potty mouthed trademarks along with real cultural disparaging Trademarks, get this, most filed by someone of that culture.
The one thing Dan's team did not do is credit the author of this approach. What goes around comes around, that is the way of the world. If I have learned anything over my years is that most people figure they can copy an idea and run with it.
Not.
I will tell you the same thing I told Sears when they wanted my bunnies for an infant-toddlers bedding lifestyle collection offering 3% telling me Disney took that payout, telling me anyone can do bunnies. I answered, "I am not Disney" holding my ground on my 5%.
Sears did call back. My bunnies outsold Disney babies on like product, and Potter too. Sears later conceded, anyone can draw bunnies but not anyone can draw my bunnies, art with heart.
My lesson to Dan. Anyone can read an article than run with it as their own. Only the author of the article understands the foundation of the idea that led to a left of centrist thinking approach. And that my dear Dan is my note to you.
A thank you from the big guy was always in order. When a lower level staffer 'borrows' another's idea, then, my dear Dan, you get what you pay for BUT what you do, again, now here, is at a cost to my community of global ARTS content creators you continue to dig an economic grave for by things you are doing on the down low and the slide by.
